Resumo(s)A investigação desenvolvida procura apresentar uma noção mais aprofundada sobre questões que se afirmam essenciais relativamente ao crime de incêndio florestal em Portugal. A investigação centrou-se no estudo dos incêndios florestais ocorridos em Portugal, sobretudo entre 2000 e 2010 e as respetivas causas como mote para uma posterior abordagem criminal. Compreender o fenómeno na tríade ocorrências, área ardida e detidos por crime de incêndio florestal afigurou-se pertinente. O tratamento de informação estatística e documental permitiu traçar o panorama geral dos incêndios florestais no país e compreender o contributo da ação humana. O elevado número de ocorrências e área ardida em Portugal deve-se em muito ao contexto de ocupação humana do espaço, pelas práticas tradicionais de uso do fogo, pelo abandono sucessivo dos espaços rurais e consequente acumulação de mato e ao crescimento florestal desordenado. Por seu turno, o espaço urbano em interface com o espaço rural cria uma dubialidade crescente, potenciando o risco. Sabendo que são as causas de origem humana que estão no começo da maioria dos fogos, é importante analisar o tema sob a perspetiva analítica do quem, onde e porquê, pois conhecer o comportamento humano é fundamental para prevenir e minimizar as consequências dos incêndios florestais. A imputação de responsabilidades de quem comete o crime de incêndio florestal é por vezes difícil, tanto mais na ausência de prova, sobretudo tratando este, de um crime de difícil constituição de prova, quer material quer testemunhal. Em termos gerais, pode dizer-se que a investigação de causa provável e investigação criminal do delito de incêndio florestal em Portugal carecem de maior atenção por parte das autoridades que, por tradição cultural e falta de meios negligenciam por vezes este delito face a outros.
The research developed try to present a concept even further on issues that claim be essential for the state of crimes of forest fire in Portugal. The investigation focused on the study of forest fires in Portugal, between 2000 and 2010 and their causes as a motto for a later criminal approach. Understanding the phenomenon in the occurrences, burnt area and arrested for the crime of forest fire appeared to be relevant. The treatment of statistical information and documentary allows us to trace the overview of forest fires in the country and understand the contribution of human action. The high number of occurrences and burnt area in Portugal is due to the very context of human occupation of space, for traditional practices of use of fire, for the subsequent abandonment of rural areas and consequent accumulation of weeds and disordered growth forest. Meanwhile, the urban interface with rural areas creates a growing dubious, enhancing the risk. Knowing that causes of human origin are the beginning of most fires it is important to analyze the topic from the analytical perspective of whom, where and why, because knowing human behavior is crucial to prevent and minimize the consequences of forest fires. The allocation of responsibilities of who commits the crime of forest fire is sometimes difficult, especially in the absence of test and particularly treating this like a crime of difficult formation test, both materially and witnesses. In general terms it can be said that the investigation of probable cause and criminal investigation of offense forest fire in Portugal, need further attention by the authorities that, by cultural tradition and lack of resources, sometimes overlook this crime against others.
