Os bastidores dos crimes de ódio: dimensões sociais e identitárias

Abstract

A presente dissertação faz uma análise dos crimes de ódio, analisando tudo o que neles poderá interferir. Apesar de incidir, essencialmente, no aspeto da cultura, ireime referir também a aspetos pessoais, económicos e sociais. A bibliografia e os estudos referentes a estes crimes são relativamente recentes. Além disso tendem a incidir apenas no ato, em si, criminoso ou desviante. Contrariando esse percurso, este estudo desvia-se do crime em si e foca-se na cultura que o enforma e antecede. Foco-me nas motivações de carácter grupal e coletivo que poderão estar associadas a estes crimes. É neste contexto que refiro o conceito de “cultura de ódio”, ou seja, a cultura que se vai enraizando nos grupos através de discursos e de atos protagonizados pelos seus “líderes”. Para perceber o que poderá estar na base de um crime desta ordem interessa explicar que um crime de ódio é qualquer ato criminal que seja motivado por um preconceito seja ele racial, sexual ou religioso. É com base em preconceitos desta ordem que se poderá explicar o aparecimento de alguns grupos de ódio. Os perfis, tanto do ofensor como da vítima; a importância que o grupo pode ter, os discursos de ódio e a (sub)cultura foram também discutidos ao longo do trabalho de forma a explanar qual o efeito das palavras e da (sub)cultura destes grupos nos seus membros. Referi o caso dos skinheads (Hammerskins e Blood and Honour), dado tratar-se de um grupo conhecido, essencialmente, pelo seu discurso de ódio e atos de violência. A dissertação é de cariz exploratório, tratando-se de uma recolha de informação, sobretudo documental e bibliográfica. Foquei-me nas diferentes formas de definir crimes de ódio; no apuramento de conceitos como racismo, xenofobia, homofobia e discriminação. Com vista a conseguir responder à minha questão irei centrar-me em questões como a cultura, o efeito dela nos grupos, para depois, imediatamente, prosseguir para a análise dos grupos em questão: Hammerskins e Blood and Honour. Visto ser um objetivo analisar e enquadrar este tipo de crime em Portugal, será necessário proceder a uma recolha de notícias que possam envolver crimes deste tipo. Tal contribuirá para evidenciar até que ponto o nosso país dá atenção aos crimes de ódio ou reconhece a sua importância.

The present dissertation makes the analysis of hate crimes, analyzing what aspects are involved in these crimes. Although the focus is, essentially, related to the aspect of culture, I'll also mention the personal, economic and social aspects. Literature and studies that develop these crimes are relatively recent. They also tend to focus only on the deviant or the criminal act itself. Contradicting this route, this study parts from the crime itself and focuses on the culture that precedes it and makes it happen.. During this dissertation, I focus on the group and on the collective motivations that may be associated with this type of crimes. In this context, I state the concept of "culture of hatred", which is the culture that roots in these groups, expressed in their speeches and acts, intended by their "leaders". To understand what can be the basis of this type of crimes, it’s important to explain that a hate crime is a criminal act which is motivated by a racial, sexual or religious prejudice. Based on prejudices of this order, we may explain how some hate groups appear. The profiles of the offender and the victim, the importance that the group may have, hate speeches, and the (sub)culture were also mentioned in this dissertation to explain the speech and the (sub)culture of these groups and how they influence their members. I mentioned the skinhead case (Hammerskins and Blood and Honour), because this is a group known especially for its hate speeches and acts of violence. This dissertation has an exploratory nature; it aimed to gather information, based specially on documents and literature. I focused on different ways of defining hate crimes, the clarification of concepts such as racism xenophobia, homophobia and discrimination. In order to open avenues for answering my question, I will focus on issues such as culture, the effect of the culture within groups and finally I will proceed to the analysis of the groups Hammerskins, Blood and Honour. As it is a goal to analyze this type of crimes in Portugal, I tried to identify news in the press that may involve such crimes. This will help to show how our country is far from devoting enough attention to hate crimes or from recognizing their importance.
