Crianças maltratadas em contexto familiar: o papel da Comissão e Proteção de Crianças e Jovens

Abstract

A presente investigação incide sobre um problema que preocupa e assombra a nossa sociedade – “crianças maltratadas em contexto familiar”. Não há dúvida que é um tema que exige um certo cuidado e sensibilidade, especialmente porque estamos a falar de maus-tratos praticados a crianças e jovens. Felizmente, este tema tem ocupado um espaço cada vez mais importante no cenário nacional, sendo os media os principais responsáveis por uma maior consciencialização social, uma vez que denunciam informam e apelam à sensibilidade e responsabilização das pessoas. O aumento de programas e discussões específicas e qualificadas sobre o tema dão prova que o país tem concentrado esforços na denúncia, prevenção e diminuição desta prática que viola os direitos humanos fundamentais. É fundamental falar deste flagelo, mas mais do que isso é urgente e prioritário identificar as verdadeiras causas inerentes a este problema de modo a elaborar um conjunto de ações concretas e mecanismos eficazes no combate e prevenção aos maustratos infantis. Este papel cabe não só às Comissões de Proteção de Crianças e Jovens, mas também ao Estado e à Sociedade, que devem orientar-se por princípios que assentem na promoção dos direitos e proteção das crianças e jovens, atender às necessidades que por eles são sentidas e atuar no sentido de prevenir situações que coloquem em causa a sua segurança, saúde, formação, educação e desenvolvimento integral. É neste seguimento que esta investigação cujo tema é “Crianças maltratadas em contexto familiar – O papel da Comissão e Proteção de Crianças e Jovens” se propõe abordar de forma genérica o que são maus-tratos, assim como os variados tipos de maus-tratos existentes e os respetivos modelos explicativos que estão na base desta prática que é cada vez mais recorrente. De igual forma, é dado enfoque ao papel desempenhado pela Comissão de Protecção de Crianças e Jovens, tal como à intervenção do Estado e da Sociedade. É ainda importante analisar a evolução histórica da lei assim como o enquadramento familiar em que as crianças estão inseridas, de forma a compreender e contextualizar a dimensão deste problema.

The present investigation is based on the main issue that concerns and shadows our society - "ill-treated children in the family context". It is without doubt an issue that requires a certain understanding and care, especially because we are talking about the bad treatment towards children and teenagers. Fortunately, this issue has taken up more and more space within our national senary, having the help of the "media" responsible for the acknowledgement of what is going on around us and in many households. They expose and inform, and also, reach out to the public to become aware and hold those responsible for this terrible plague. The increase of programs and specific discussions about this issue prove that the country is concentrated in reporting these cases, in order to prevent and decrease this practice which violates the fundamental human rights. It is fundamental to talk about this plague, and even more so it is urgent and a priority to identify the true causes inherent to this problem so that a set of specific actions and effective mechanisms in fighting and avoid child maltreatment should be implemented. This role belongs, not only to the Child and Teenage Protection Comission, but also, to the State and Society, whose intentions are centered in promoting the rights and protection of children and teenagers. They should also attend to the needs felt within society and act towards prevention of those situations that undermine the security, health, formation, education and integral development. Complementing this investigation - "Maltreated Children in the Family Concept - the role of the Children and Teenage Protection Commission" , we purpose to deal with what are the forms of ill treatment, as well as, the several types of existing forms and the respective explicative motives which are the cause of this common practice. In the same way, the role played by the commission is also shown as well as that of the State and Society. It is also important to analyze the historical development of the law in accordance to the family and the children within to understand and contextualize this problem and its dimension.
