Resumo(s): | A imaginação, a criatividade e a inovação sempre fizeram parte da vida do
homem. Desde cedo que o mercado procurou proteger esta capacidade de criar e inovar,
indagando satisfazer os interesses dos seus titulares e daqueles que poderiam dela
beneficiar. Hoje, as exigências do mercado tornaram-se maiores e os interesses
económicos antes consignados aos territórios de cada país procuram estabelecer relações
além-fronteiras. Desde cedo, a União Europeia se debateu por desenvolver projetos
tendentes à unificação dos direitos de propriedade intelectual, mormente, marcas,
desenhos ou modelos e patentes, sendo certo que, no caso das patentes a tarefa revelouse
(e revela-se) mais difícil.
É neste contexto que surge o “pacote legislativo” relativo à patente europeia com
efeito unitário, após um percurso de, aproximadamente, 40 anos de tentativa de criação
(frustrada) de um título jurídico unitário de patente válido para a (atual) União Europeia.
Este pacote da patente europeia unitária é composto, essencialmente, por três textos
normativos: o Regulamento (UE) n.º 1257/2012 de 17 de dezembro de 2012, pelo qual se
estabelece uma cooperação reforçada no domínio da criação da proteção unitária de
patentes; o Regulamento (UE) n.º 1260/2012, de 17 de dezembro de 2012, que
regulamenta a cooperação reforçada no domínio da criação da proteção unitária de
patentes no que diz respeito ao regime de tradução aplicável; o Acordo Relativo ao
Tribunal Unificado de Patentes de 19 de fevereiro de 2013.
Com a presente dissertação pretende-se proceder a uma análise do referido
“pacote legislativo”, com maior incidência sobre o Acordo Relativo ao Tribunal
Unificado de Patentes, por forma a perspetivar os desafios futuros. Assim, pretende-se
inicialmente analisar as várias vias de proteção de patentes atualmente existentes, de
modo a extrair as vantagens e desvantagens de umas e outras. Posteriormente procederse-
á à análise, mais direta, da história atribulada sobre a criação da patente da UE, agora
convertida em patente europeia com efeito unitário, procurando estudar as várias
propostas e alterações que foram sendo efetuadas até à versão final que compõe o “pacote
legislativo”. De seguida, analisar-se-á o Acordo Relativo ao Tribunal Unificado de
Patentes, extraindo os aspetos principais do funcionamento deste Tribunal. Por fim,
proceder-se-á um estudo das fragilidades deste tribunal e dos desafios que terá de
enfrentar no futuro. Imagination, creativity, and innovation have always been part of man's life. From an early age the market sought to protect this ability to create and innovate by seeking to satisfy the interests of its holders and those who could benefit from it. Today, the demands of the market have become greater and the economic interests previously assigned to the territories of each country seek to establish relations across borders. From an early stage, the European Union has been struggling to develop projects for the unification of intellectual property rights, especially trademarks, designs, and patents, although in the case of patents the task has revealed to be difficult. It is in this context that the "legislative package" on the European patent with unitary effect arises, after a course of approximately 40 years of attempted (frustrated) creation of a unitary patent legal title valid for the (current) European Union. This package of the European unitary patent consists essentially of three pieces of legislation: Regulation (EU) 1257/2012 of 17 December 2012 establishing an enhanced cooperation in the field of the creation of unitary patent protection; Regulation (EU) 1260/2012 of 17 December 2012 regulating enhanced cooperation in the field of the creation of unitary patent protection with regard to the applicable translation regime; the Agreement Concerning the Unified Patent Court of February 19, 2013. This dissertation intends to analyze the "legislative package", with a greater impact on the Unified Patent Court Agreement, to analyze the future challenges. Thus, it is initially intended to analyze the various existing patent protection avenues, to extract the advantages and disadvantages of each other. Later, a more direct analysis of the troubled history of the creation of the EU patent, now converted into a European patent with unitary effect, will be carried out, seeking to study the various proposals and changes that have been made until the final version that composes the patent. "Legislative package". Next, the Agreement Concerning the Unified Patent Court will be analyzed, extracting the main aspects of the functioning of this Court. Finally, a study will be made of the weaknesses of this court and the challenges it will face in the future. |
