Resumo(s): | Este trabalho é o resultado de um estudo sobre mediação familiar e de como esta vem
sendo desenvolvida em Portugal e no Brasil. O Direito de Família é o ramo do direito
civil que se ocupa das relações familiares e das normas que as regulam. No estudo foi
demonstrado que a família, célula da sociedade, devido a transformações pelas quais
vem passando no decorrer da história humana, evolui continuamente seu conceito. A
mediação familiar se apresenta como solução adequada dos conflitos familiares por ser
o método alternativo ao sistema de justiça tradicional que melhor se adequa aos casos de
relações duradouras que envolvem afeto. Quando as características e técnicas da
mediação familiar são empregadas pelo mediador, figura de extrema importância no
processo de mediação, ocorre o restabelecimento do diálogo entre as partes.
Consequentemente, as partes são livres das travas emocionais para encontrar por elas
mesmas a melhor solução do conflito no qual estão inseridas. Alcançado um acordo
desta forma e dentro dos limites estabelecidos no ordenamento jurídico, teremos
menores percentuais de incumprimentos, bem como de tramitações de processos de
execução ou ações desnecessárias nos tribunais de justiça. Apesar de não ser seu
objetivo, esta é mais uma contribuição da mediação ao sistema de justiça tradicional. Na
prática, a mediação familiar deve obediência aos limites e imposições legais para que
eventuais acordos sejam válidos.O ponto principal deste trabalho foi o estudo da
evolução histórico-legal da mediação em Portugal e no Brasil, países com pontos em
comum em termos de mediação, mas com diferentes resultados. Em Portugal, o esforço
legislativo vem, aos poucos sendo recompensado, mas percebemos que ainda não houve
a quebra do paradigma de que conflito só se resolve no tribunal e com vitória de um e
derrota de outro. No Brasil, os esforços dos Poderes executivo, legislativo e judiciário
transformaram a mediação numa opção real aos jurisdicionados que hoje já podem fazer
uso dela dentro dos próprios tribunais de justiça. This work is the result of a study about family mediation and how it has been developed in Portugal and Brazil. Family law is the branch of civil law that deals with family relations and the norms that regulate them. In the study it was demonstrated that the family, cell society, due to the transformations that it has been going through in human history, continuously evolves its concept. Family mediation presents itself as an adequate solution to family conflicts because it is the alternative method to the traditional justice system that best fits the cases of lasting relationships involving affection. When the characteristics and techniques of family mediation are employed by the mediator, it is extremely important in the process of mediation, the reestablishment of dialogue between the parties occurs. Consequently, the parties are free from the emotional blocks to find for themselves the best solution to the conflict in which they are inserted. Once an agreement has been reached in this way and within the limits established in the legal system, we will have lower percentage of noncompliance, as well as processing of execution processes or unnecessary actions in the courts. Although not their goal, this is yet another contribution of mediation to the traditional justice system. In practice, family mediation must obey legal limits and impositions so that any agreements are valid. The main point of this work was the study of the historical-legal evolution of mediation in Portugal and Brazil, countries with common points in terms of mediation, but with different results.In Portugal, the legislative effort is gradually being rewarded, but we realize that there has not yet been a breakdown of the paradigm of which conflict is only resolved in court and with one victory and another defeat. In Brazil, the efforts of the Executive, Legislative and Judicial Powers have made mediation a real option for the courts that can now make use of it within the courts of law. |
