Garantias do financiador: da reserva de propriedade à hipoteca

Abstract

A presente dissertação terá como objeto de estudo algumas das garantias utilizadas pelas Instituições Financeiras de Crédito e Instituições Bancárias, para salvaguardarem a sua posição quando concedem crédito a um terceiro. Em especial, debruçar-nos-emos sobre a reserva de propriedade, utilizada de forma tão amiúde por estas Instituições, e procuraremos demonstrar as fragilidades que o recurso a esta figura jurídica acarreta. Por outro lado, será apresentada a figura da hipoteca como uma alternativa à reserva de propriedade, sendo que se procurará dar a conhecer, através da análise de aspetos práticos, as vantagens que o recurso à hipoteca pode trazer, (pelo menos em comparação com a reserva de propriedade) para a Entidade que concede o crédito.

This paper will have as main theme the study of some guarantees used by Financial Institutions, as well as Bank Institutions, in order to ensure their position when they conceed credit to any person or institution. Mostly, we will talk about the reservation of title, used so often by those Institutions, and we will try to demonstrate the liabilities of using this legal figure. In the other hand, the mortgage of movable property will be presented as an alternative to the reservation of title, and so, through the analysis of practical aspects, the goal is to show the advantages that the mortgage of moving property can bring with itself (at least in comparison with the reservation of title), for the Institution that conceeds the credit.
