O femicídio como fim da linha na violência em contexto de intimidade: análise de processos judiciais

Abstract

Esta investigação visa explorar quais os fatores culturais, sociais, legais e judiciais associados à prática de femicídios em Portugal. O trabalho foi desenvolvido com base na análise de acórdãos do Tribunal da Relação de Coimbra e o do Supremo Tribunal de Justiça. Com base numa metodologia de cariz misto, numa primeira fase, utilizou-se uma metodologia quantitativa de cariz descritivo. Numa segunda fase, e seguindo uma abordagem qualitativa, realizou-se análise de conteúdo dos acórdãos. Foi conferido especial destaque à violência prévia ao femicídio e às motivações dos agressores. Constatou-se que a violência física e psicológica por parceiros/as íntimos/as, bem como o stalking e comportamentos controladores, são os principais tipos de violência prévia associados ao femicídio. Relativamente aos motivos pelos quais os agressores matam a(s) sua/suas (ex) companheira/as destacam-se novas relações e a manifestação da intenção de separação por parte das vítimas. De forma menos significativa, surgem a recusa do agressor em aceitar o fim do relacionamento e a oficialização de denúncias de violência nas autoridades policiais por parte das vítimas.

This research aimed to explore which are the cultural, social, legal and judicial factors associated with the practice of femicide in Portugal. The work was developed by analysing the Court of Appeal of Coimbra and the Supreme Court of Justice’s decisions. Based on a mixed methodology, it was used a quantitative and descriptive methodology in the first phase of the analysis. In the second phase of the empirical analysis, and following a qualitative approach, attempts have been made to interpret the results achieved through the content analysis of the Court’s decisions. Special emphasis was given to the previous violence of femicide and the motivations of the aggressors. Physical and psychological violence used by intimate partners, as well as stalking and controlling behaviors are the main types of previous violence associated to femicide. Regarding the reasons why aggressors kill their (ex) partner, new relationships and the manifestation of the intention of separation by the victims stand out as the main reasons. Less significantly, the refusal by the aggressor in accepting the end of the relationship and the official reporting of violence to the authorities by the victims emerge also as motivations to the femicides analyzed.
