A (in)dependência das entidades reguladoras: o caso ANAC

Abstract

A presente dissertação reflete sobre a questão da independência que envolve as entidades administrativas independentes, principalmente as autoridades reguladoras independentes. O objeto de investigação desta dissertação incide sobre a Autoridade Nacional de Aviação Civil (ANAC) e pretende discutir as principais características das entidades, por sua vez análogas a todas as entidades reguladoras independentes no sentido de perceber quais as características a potencializar para resultar numa independência de facto e no aumento do nível de accountability das decisões das respetivas entidades. Para isso, o trabalho de investigação apresenta factos, legislações e várias posições de académicos nacionais e internacionais que já tiveram oportunidade de analisar o tema em questão ao longo das suas carreiras, os quais foram imprescindíveis para traçar os pontos positivos e os pontos negativos acerca do status quo das autoridades reguladoras independentes e dos sistemas administrativos nacionais dos países dos estados-membros da União Europeia. Por último, esta obra também incita a um exercício lógico com o objetivo de compreender até que ponto os sistemas administrativos europeus e os sistemas administrativos nacionais poderiam convergir para alcançar a tão famigerada independência sobre estas entidades, aproveitando a ideologia ordoliberal e o sistema concorrencial europeu como forma de potencializar as suas características.

This dissertation reflects on the issue of independence involving independent administrative authorities, especially independent regulatory authorities. The object of investigation of this dissertation focused on the National Civil Aviation Authority (ANAC) and intends to discuss the main characteristics of the entities, in turn analogous to all independent regulatory entities in the sense of perceiving the characteristics to be potentiated to result in independence de facto and the increase of the level of accountability of the decisions of the respective entities. Furthermore, this dissertation presents facts, legislations and various positions of national and international scholars who have already had the opportunity to analyze the theme in question throughout their careers, which were essential to trace the positives and negatives about the subject. status quo of the independent regulatory authorities and the national administrative systems of the countries of the Member States of the European Union. Finally, this work also prompts a logical exercise in order to understand the extent to which European administrative systems and national administrative systems could converge to achieve the so-called independence of these entities, taking advantage of the ordoliberal ideology and the European competitive system as way of potentializing its characteristics.
