Resumo(s): | A Efetividade dos Direitos Fundamentais do ponto de vista do Constitucionalismo
Timorense/Constituição da RDTL – República Democrática de Timor-Leste/2002, no quadro da
dimensão como um Estado de Direito Democrático, é o tema que a presente tese de doutoramento
pretende tratar e abordar como principal assunto da sua realização.
Timor-Leste foi, desde sempre, um país padecente de sucessivas tentativas de ocupação por
parte de vários países, tendo em conta a sua riqueza de bens materiais. Com a chegada dos
portugueses no seu território iniciou-se o processo designado de colonização, onde Timor-Leste,
antigamente designado apenas de Timor, foi governado e administrado pelos portugueses durante o
século XVI. Este processo permitiu estabelecer laços de união entre portugueses e timorenses. De
destacar a maior identidade do povo português: a Língua Portuguesa.
Timor-Leste viu a sua normalidade alterada no momento em que Portugal declarou liberdade
às suas províncias ultramarinas após o golpe de Estado do 25 de Abril, iniciando, assim, um período de
guerra civil, dado que a Indonésia invadiu o território timorense. Foi um período conturbado e marcado
pela violação dos direitos humanos.
Vários grupos emergiram e consolidaram as suas forças e uma forte união, designadamente a
Resistência Timorense. Neste contexto, cria-se em 20 de agosto de 1975, as FALINTIL,
designadamente as Forças Armadas de Libertação de Timor-Leste, bem como a Frente Clandestina e a
Frente Diplomática. A luta de todas estas forças políticas, e de todos os cidadãos, em muito
contribuíram para a sua libertação. Este ato heroico resultou na liberdade de todos e na independência
de um país, alcançada verdadeiramente em 20 de maio de 2002.
Com o estabelecimento da Constituição da República Democrática de Timor-Leste surge um
país independente e democrático. De realçar os direitos que restabeleceram ao povo timorense a
dignidade e o respeito, bem como a libertação de um país e a libertação de cada um enquanto
indivíduos. The Effectiveness of Fundamental Rights from the point of view of Timorese Constitutionalism / Constitution of the RDTL - Democratic Republic of Timor-Leste / 2002, within the framework of the dimension as a State of Democratic Law, is the theme that this doctoral thesis intends to address and address as the main subject of its realization. Timor-Leste has always been a country suffering from successive attempts at occupation by several countries, taking into account the wealth of material goods. With the arrival of the Portuguese in their territory, the process of colonization began where Timor-Leste, formerly known only as Timor, was governed and administered by the Portuguese during the 16th century. This process made it possible to establish ties of union between the Portuguese and the Timorese. To highlight the greatest identity of the Portuguese people: the Portuguese Language. Timor-Leste saw its normality altered when Portugal declared freedom to its overseas provinces after the April 25 coup d'état, thus beginning a period of civil war, given that Indonesia invaded East Timorese territory. It was a troubled period marked by the violation of human rights. Several groups emerged and consolidated their forces and a strong union, namely the Timorese Resistance. In this context, on August 20, 1975, FALINTIL was created, namely the Armed Forces for the Liberation of Timor-Leste, as well as the Clandestine Front and the Diplomatic Front. The struggle of all these political forces, and of all citizens, contributed a great deal to their liberation. This heroic act resulted in the freedom of all and the independence of a country, which was truly achieved on May 20, 2002. With the establishment of the Constitution of the Democratic Republic of Timor-Leste, an independent and democratic country appears. To highlight the rights that restored dignity and respect to the Timorese people, as well as the liberation of a country and the liberation of each one as individuals. |
