A prova diabólica em Portugal e no Brasil

Abstract

A presente dissertação de mestrado versa sobre a distribuição do ónus da prova no direito processual civil português e no direito processual civil brasileiro, através de uma comparação entre ambos. Pretende-se aqui fazer uma analíse da Teoria da Distribuição Dinâmica e da Teoria Estática do Ónus da Prova, da forma como ambas se manifestam nos ordenamentos jurídicos de cada País e qual deverá ser a visão do ordenamento juridico português perante a questão da prova diabólica. A escolha deste tema deve-se ao papel fundamental que as provas desempenham no que toca à resolução de conflitos presentes no mundo do Direito, tal como o conhecemos atualmente, bem como à carência de atenção a que a matéria relativa à distribuição do ónus da prova está sujeita por parte da doutrina e da jurisprudência portuguesas. Com este trabalho pretende-se, fundamentalmente, mostrar que este é um assunto que merece ser tomado em consideração por parte do legislador português, que necessita de ser repensado e de que está na altura de o ordenamento jurídico se atualizar no que diz respeito à distribuição do ónus da prova.

This master's dissertation is about the distribution of the burden of proof in Portuguese civil procedural law and Brazilian civil procedural law, through a comparison between them. It is intended here to make an analysis of the Dynamic Distribution Theory and the Static Distribution Theory of the Burden of Proof, as both manifest themselves in the legal systems of each country and what should be the view of the Portuguese legal system towards the question of the devil‟s proof. The choice of this subject is due to the fundamental role that evidences have in the resolution of conflicts in the world of Law, as we know it today, and the lack of attention that the matter of the distribution of the burden of proof have in the Portuguese doctrine and jurisprudence. The objective of this paper is, above all, to show that this is a matter that should be taken into consideration by the Portuguese legislator, which needs to be rethought and that it is time for the legal system to update itself regarding the distribution the burden of proof.
