Regulação bancária no plano nacional e no plano europeu: um olhar sobre o presente e sobre o futuro

Abstract

A presente dissertação foca-se no estudo da regulação e supervisão bancária no plano nacional e no plano europeu, quer a sua atuação no presente, quer a sua atuação num futuro próximo. A crise financeira de 2007/2008, juntamente com as crises das dívidas soberanas de 2010, despertou a reestruturação das arquiteturas nacionais e da arquitetura europeia de regulação e supervisão financeira, de forma a que tanto os sistemas financeiros nacionais como o sistema financeiro europeu se tornassem mais resilientes, mais sólidos e mais blindados face à emergência de uma futura crise económico-financeira. Todavia, além de surgir a exigência de reestruturação das arquiteturas nacionais e da arquitetura europeia, com a crise económico-financeira internacional de 2007/2008 surge a primeira moeda virtual (a bitcoin) e a tecnologia Blockchain, tecnologias com a capacidade de alterar o atual paradigma financeiro e de perturbar o normal e bom funcionamento do sistema financeiro internacional. Embora se tenham efetuado algumas reconfigurações na arquitetura nacional e europeia de regulação e supervisão financeira, será necessário concluir alterações que se encontram por executar, bem como tomar medidas regulatórias quanto às criptomoedas e à tecnologia Blockchain, com vista a salvaguardar a estabilidade financeira europeia e nacional.

This dissertation focuses on the study of banking regulation and supervision at the national and european levels, both its performance in the present and its performance in the near future. The financial crisis of 2007/2008, together with the sovereign debt crisis of 2010, awaked the restructuring of national architectures and the european architecture of financial regulation and supervision, in such a way that both national and financial systems become more resilient, stronger and more armored in front the emergence of a future economic and financial crisis. However, in addition to the need to restructure national architectures and european architecture, with the international economic and financial crisis of 2007/2008 comes the first virtual currency (Bitcoin) and Blockchain technology, technologies with the ability to change the current financial paradigm and disrupt the normal and good functioning of the international financial system. Although some reconfigurations have been made in the national and european architecture of financial regulation and supervision, it will be necessary complete the changes which are still to execute, as well as to take regulatory measures regarding cryptocurrencies and Blockchain technology to safeguard european and national financial stability.
