A jurisprudência multicultural do tribunal constitucional português: Mapeamento e análise crítica

Abstract

Tendo como pano de fundo os debates sobre as implicações da diversidade cultural para o Direito e a prática judicial, este texto faz um mapeamento e análise crítica dos acórdãos do Tribunal Constitucional português subsumíveis à categoria jurisprudência multicultural, atentando inter alia ao uso que o Tribunal faz de considerações de ordem cultural, à atenção dispensada à proteção das minorias, à avaliação de possíveis formas de discriminação e barreiras ao gozo de direitos fundamentais, à ponderação entre igualdade e direito à diferença e ao diálogo com os parâmetros internacionais de direitos humanos e respetivos organismos de supervisão.

Against the background provided by ongoing debates on the challenges brought by cultural diversity to law and judicial practice, this paper makes an inventory and critical assessment of the judgments of the Portuguese Constitutional Court that fall under the category of multicultural jurisprudence. The review considers, among other aspects, the Court’s use of cultural arguments, the care put into the protection of minorities, the attention to possible forms of discrimination and obstacles in the exercise of fundamental rights, the balance of equality and the right to difference, and the dialogue with international human rights’ standards and their respective supervisory bodies.
