Resumo(s): | O planeamento fiscal abusivo resulta essencialmente do fenómeno da globalização, com o qual
os contribuintes procuram da adoção de esquemas cada vez mais inovadores, minimizar o montante
de imposto a pagar. No entanto, conscientes da perda de receita tributária que tais comportamentos
acarretam, os Estados adotam um conjunto de medidas que visam combater os comportamentos
ilegítimos dos contribuintes face à necessidade do pagamento de impostos. Entre as opções existentes,
uma das possibilidades passa pela adoção de normas gerais antiabuso.
A presente dissertação tem como temática as normas gerais antiabuso desenvolvidas no plano
internacional, europeu e nacional, e cuja exposição assentará na análise dos trabalhos que têm sido
desenvolvidos, e cuja tónica assenta na questão da prossecução dos fins a que tais instrumentos se
propõem: o combate ao abuso em direito fiscal, e em que medida é que os diferentes planos se
articulam nesta missão. Deste modo, iremos debater a norma geral antiabuso prevista no Plano de
Ação desenvolvido pela OCDE, em conjunto com o G20, e procurar perceber se a mesma configura um
instrumento capaz de combater o abuso no plano internacional. Paralelamente, iremos analisar a regra
geral antiabuso desenvolvida pela União no âmbito da Diretiva Antielisão, e as alterações mais recentes
à cláusula geral antiabuso, resultado da transposição da Diretiva mencionada. Iremos debruçar-nos
sobre que tipo de abuso é que cada uma das normas procura combater, e se existe algum ponto de
articulação entre os vários planos.
Para tal, iremos dividir os nossos trabalhos em três capítulos. No capítulo inicial iremos realizar
um enquadramento geral do conceito de abuso, e a forma como o mesmo é percecionado nos
diferentes âmbitos – internacional, europeu e nacional. Num segundo capítulo, passaremos para o
campo das normas gerais antiabuso, decompondo os seus elementos constitutivos e percebendo quais
as suas falhas e os seus aspetos favoráveis ao combate ao abuso. Por fim, cuidaremos da efetividade
da norma do Principal Purpose Test desenvolvida pela OCDE e o G20, e qual o impacto da mesma na
articulação e aplicação de normas gerais antiabuso no plano europeu e nacional. Abusive tax planning results essentially from the phenomenon of globalization, with which taxpayers seek, through the adoption of increasingly innovative schemes, to minimize the amount of tax payable. However, aware of the loss of tax revenue that such behaviors entail, states adopt a set of measures aimed at combating the illegitimate behavior of taxpayers in the face of the need to pay taxes. Among the existing options, one of the possibilities is the adoption of general anti-abuse rules. This study has as its subject the general anti-abuse rules developed at the international, european and national levels, which will be based on the analysis of the work that has been carried out, and whose emphasis is on the question of the pursuit of the purposes for which such instruments are proposed: the fight against abuse in tax law, and to what extent the different plans are articulated in this mission. In this way, we will discuss the general anti-abuse standard foreseen in the Action Plan developed by the OECD, together with the G20, and try to understand if it configures an instrument capable of fighting abuse at the international level. In parallel, we will analyze the general anti-abuse rule developed by the Union in the framework of the Anti-abuse Directive, and the most recent changes to the general anti-abuse clause, resulting from the transposition of the mentioned Directive. We will focus on what kind of abuse each of the rules seeks to combat, and whether there is any point of articulation between the various plans. To this end, we will divide our work into three chapters. In the initial chapter we will carry out a general framework of the concept of abuse, and the way it is perceived in the different spheres – international, european and national. In a second chapter, we will move to the field of general antiabuse norms, decomposing their constitutive elements and perceiving their flaws and their favorable aspects for combating abuse. Finally, we will take care of the effectiveness of the Principal Purpose Test standard developed by the OECD and the G20, and its impact on the articulation and application of general anti-abuse standards at European and national levels. |
