A tributação das atividades petrolíferas angolanas: a natureza jurídica das imposições devidas pela produção e pelo rendimento do petróleo

Abstract

A presente dissertação procura contribuir para aferir da natureza jurídica dos encargos que incidem sobre a produção e sobre o rendimento do petróleo, no sentido de determinar a possibilidade de serem considerados como impostos ou taxas, ou ainda como preços, com base nas respetivas características. Atender-se-á, para o efeito, aos contributos doutrinários já existentes, tanto no domínio jurídicoeconómico, como no âmbito jurídico-tributário. Trata-se de um estudo que permitirá aferir da conformidade constitucional do regime jurídico aplicável a estas imposições tão relevantes no contexto angolano e que contende, desde logo, com os termos em que são criadas e alteradas.

This dissertation seeks to contribute to the assessment of the legal nature of the charges on oil production and income, to determine the possibility of being considered as taxes and duties, or as prices, based on their characteristics. To this end, existing doctrinal contributions, both in the legal and economic field and in the legal-tax field, will be used. It is a study that will allow the assessment of the constitutional conformity of the legal regime applicable to these impositions so relevant in the Angolan context and which disputes, from the outset, the terms in which they are created and amended.
