Institucionalização e lei tutelar educativa: as representações de jovens, profissionais e direção de um centro educativo

Abstract

A presente investigação reporta-se ao fenómeno da delinquência juvenil, especificamente às representações de jovens, profissionais e direção de um Centro Educativo no norte de Portugal e tem como objetivo conhecer as representações destes sujeitos relativamente a: i) trajetórias dos jovens a cumprir medida de internamento; ii) intervenção levada a cabo por instituições desta natureza; iii) e Lei Tutelar Educativa. Trata-se de uma investigação de índole qualitativa que recorre ao método do estudo de caso, pelo facto de incidir num contexto em particular e desenvolvida a partir das representações de um conjunto de indivíduos pertencentes a este contexto. Posto isto, e considerando as opções metodológicas, importa salientar que não é nosso propósito generalizar os resultados obtidos. A entrevista semi-estruturada e a pesquisa documental representam os instrumentos de recolha de dados empíricos selecionados, sendo que a entrevista foi aplicada a todos os participantes do estudo e a pesquisa documental residiu na consulta dos processos individuais dos jovens a executar a medida de internamento e do projeto educativo do Centro. Como referido, a amostra contempla três grupos de sujeitos de um Centro Educativo: jovens, profissionais e direção, pelo que são participantes no estudo nove jovens com diferentes tempos de medida (3 jovens no inicio da medida, 3 jovens a meio da medida e 3 jovens no fim da medida), três profissionais e um elemento da direção. Confirma-se que as representações dos educandos não são inteiramente dissemelhantes das representações dos educadores, nomeadamente no que respeita à trajetória socio-educativa e ao comportamento dos jovens antes do internamento, às funções do Centro Educativo e à importância da passagem pela instituição para a vida futura destes jovens e ao facto de todos os sujeitos considerarem o técnico uma figura preponderante e de referência ao longo de todo o processo. Verificam-se representações distintas relativamente ao sistema normativo da instituição, à Lei Tutelar Educativa e às expectativas face ao futuro destes jovens.

The present investigation refers to the phenomenon of juvenile delinquency, specifically in representations of youngsters, professionals and managing directors of the Education Center in northern Portugal. The paper aims to recognize the representations of these subjects in relation to: i) trajectories of young people to fulfill internment measure ii) intervention carried out by such institutions; iii) education and Guardianship Law. The investigation has qualitative character that employs a case study method, in order to focus on particular and developed context of representations of certain groups of individuals belonging to investigated matter. As a result, considering methodological options, it should be noted that the purpose is not to generalize the outcome. The semi-structured interviews and documentary research represent selected instruments of collection of empirical data. The interview was applied to all study participants and documentary research was held in the consultation processes of individual youngsters performing the measure of internment and taking part in the educational project in the Education Center. As mentioned earlier, the sample includes three groups of subjects of Education Center: youngsters, professionals and managing directors. In particular, there were nine young participants in the study with different times of measurement (three young people at the beginning of the measure, three through the measurement and three at the end of the measurement), three professionals and also an element of managing directors. It is confirmed that the representations of the students are not entirely dissimilar to representations of educators, particularly in relation to socio-educational trajectory and behavior of young people before admission, as well as functions of the Education Center, the importance of the residency in the institution for the future life of these young people and the fact that they considered their professional guardians an important figure and reference throughout the whole process. There is distinct representations concerning the normative system of the institution, the Education and Guardianship Law and the expectations regarding the future of these young people.
