A nova diretiva europeia sobre marcas e a sua transposição para a ordem jurídica portuguesa

Abstract

Estando a decorrer o prazo para a transposição das normas da nova Directiva de Marcas (Directiva (UE) 2015/2436 do Parlamento Europeu e do Conselho, de 16/12/2016) que alteram substancialmente as versões que a antecederam, creio ser oportuno analisar o regime jurídico aí estabelecido e reflectir sobre as alterações que, por essa razão, tenham de vir a ser introduzidas no direito nacional de marcas. É este o objectivo do presente estudo, no qual procuro abordar as principais alterações de direito substantivo e procedimental.

As the deadline for the transposition of the new Trade Marks Directive (Directive (EU) 2015/2436 of the European Parliament and of the Council of 16 December 2015) rules which substantially change the versions that preceded it is running, it is considered appropriate to examine the legal framework established there and to reflect on the amendments which should be made to national trademark law. This is the purpose of this study, in which I attempt to address the main substantive and procedural changes.
