O contrato de gestão de carteiras: dos actos tendentes à sua valorização

Abstract

Numa economia à escala global onde o mercado financeiro assume um papel preponderante, o Direito vê-se obrigado a acompanhar a evolução da realidade financeira. Pelo que novos desafios lhe são impostos, novas figuras jurídicas são criadas, novos regimes jurídicos são estabelecidos. É, assim, que o contrato de gestão de carteiras se afirma constituindo uma resposta na regulamentação das actividades de intermediação financeira. Nessa medida, urge individualizar as principais características e especificidades do tipo contratual, aprofundar o regime jurídico que lhe serve de base e esmiuçar a sua natureza jurídica com a finalidade última de apresentar reflexões daquilo que poderão ser ‘actos tendentes à valorização da carteira’ inseridos numa boa gestão da mesma.

In a global economy where the financial market plays an important role, the Right has to follow the evolution of the financial reality. Therefore, new challenges are imposed, new legal figures are created, new legal regimes are established. It is thus that the contract portfolio management asserts itself constituting a reply in regulation of financial intermediation activities. In this sense, it must to individualize main characteristics and specificities of the contractual type, deepen the legal regime that serves as a basis and scrutinize its legal nature for the purpose last to present reflections of what may be acts aimed at valorization of the portfolio inserted in a good management of same.
