O crime de perseguição: subsídios para a sua compreensão no contexto da sociedade da informação

Abstract

Na era da Sociedade da informação, o típico crime, físico e imediato, dá lugar aos subterfúgios proporcionados pelos meios informáticos, auxiliares do Homem enquanto figura criminosa. O crime de perseguição, recentemente incluído no Código Penal português no artigo 154.º-A, decorre das exigências patenteadas na Convenção do Conselho da Europa para a Prevenção e o Combate à Violência Contra as Mulheres e a Violência Doméstica, conhecida como Convenção de Istambul. Muitos serão os desafios sociais e jurídicos no acolhimento deste tipo legal de crime, o qual, apesar de recente, está entrosado na cultura universal e é intrinsecamente reconhecível. À distância de “um clique”, o perseguidor pode sujeitar a vítima a reiterados ataques direccionados a suprimir a sua autodeterminação e independência, através de ameaças, assédio, contactos indesejados e calúnias, pois que a actuação delinquente se tornou mais acessível e multifacetada para quem pode, para além da perseguição física típica, esconder-se por trás de um dispositivo electrónico e provocar sérios danos psicológicos noutro ser humano.

In the era of information’s society, an average crime, physical and immediate, provides a place for subterfuge implemented by the computer mechanisms, Men’s assistants as a criminal figure. The crime of stalking, recently embodied in the Portuguese Penal Code in Article 154.º-A, follows from the requirements of the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence, known as the Istanbul Convention. There will be many social and legal challenges in hosting this legal type of crime, which, although recent, is tied to the universal culture and is intrinsically recognizable. In "one-click" distance, the persecutor may subject the victim to repeated attacks aimed at suppressing her self-determination and independence through intimidation, harassment, unwanted contact and defamation, as delinquent behavior has become more accessible and multifaceted for those who can, in addition to typical physical persecution, to hide behind an electronic device and cause serious psychological damage to another human being.
