Resumo(s): | O presente trabalho pretende analisar o ordenamento jurídico brasileiro no que diz respeito ao
instituto jurídico da guarda compartilhada, especificamente a partir de sua obrigatoriedade, e contrapôla
ao Princípio do Superior Interesse da Criança.
Iniciamos o estudo analisando o poder familiar, reconhecendo que ele é oriundo da relação
paterno-filial e é através desse poder que os pais são cobrados para estar mais próximo do cotidiano
dos filhos, acompanhando o desenvolvimento integral deles.
Vários institutos jurídicos relacionados com as crianças foram alterados com a promulgação da
Constituição Federal de 1988, sobretudo com a constitucionalização do Princípio do Superior Interesse
da Criança, em 1988, o qual integra a teoria da proteção integral da criança e estabelece que os
interesses delas devem ser colocados em evidência, inclusive no exercício do poder familiar.
Como parte do poder familiar encontra-se a questão da guarda dos filhos menores. Dentre as
modalidades de guarda, destacam-se: a unilateral, a compartilhada, a alternada e a atribuída a
terceiros; entretanto preferimos abordar majoritariamente a guarda compartilhada porque ela permite
uma convivência equilibrada entre os seus pais, mesmo que eles não vivam sob o mesmo teto.
A Lei n.º 13.058/14 alterou o Código Civil brasileiro e estabeleceu a obrigatoriedade da guarda
compartilhada, mesmo não havendo acordo entre os pais, desde que eles estejam aptos a exercer o
poder familiar. A exceção ocorre quando um dos genitores declarar perante o juiz o desinteresse na
guarda do filho.
A partir da análise da doutrina e jurisprudência brasileira, pretendemos responder à questão: a
obrigatoriedade da guarda compartilhada fere o Princípio do Superior Interesse da Criança? Essa
resposta deve levar em consideração a existência de litígios entre os pais após, o rompimento da
relação conjugal, com as suas peculiaridades. This research intends to analyze the Brazilian legal system regarding the legal institution of joint custody, specifically based on its obligation, and to counter it with the Principle of the Best Interests of the Child. We began the study by analyzing family power, recognizing that it comes from the parent-child relationship and it is through this power that parents are charged to be more attentive to their children's daily lives, accompanying their development integral. Various institutions related to children were amended with the promulgation of the Brazilian Federal Constitution of 1988, especially with the constitutionalization of the Principle of the Best Interests of the Child, which includes the theory of integrated child protection and establishes that their interests should be emphasized, including the exercise of family power. Within family power, the issue of child custody can be found. Among the types of custody, the following stand out: sole, joint, alternating and third party; however, it is preferable to approach mostly joint custody because it allows a more balanced life with their parents, even if they do not live under one roof. The Law No. 13.058/14 amended the Brazilian Civil Code and established the obligation of joint custody, even if there is no agreement between parents, provided that they are able to exercise family power. The exception occurs when one of the parents declares to the judge that they are not interested in the custody of their child. From the analysis of Brazilian doctrine and jurisprudence, this research intends to answer the question: does the obligation of joint custody violate the Principle of the Best Interests of the Child? This question must take into account the existence of disputes between parents, after the end of their conjugal relationship, with is peculiarities. |
