As problemáticas e os desafios contemporâneos em torno da gestação de substituição

Abstract

A nossa investigação procura enunciar, refletir e analisar as principais problemáticas e os desafios jurídicos desencadeados pela prática de gestação de substituição. A gestação de substituição coloca desafios a conceitos, institutos ou figuras jurídicas tradicionais, quer do Direito Contratual, quer do Direito da Família e dos Direitos Fundamentais de todas as partes envolvidas. No nosso ordenamento jurídico, as alterações legislativas introduzidas pela Lei n.º 25/2016, de 22 de agosto, suscitaram a necessidade de uma nova reflexão sobre esta temática. O Acórdão do Tribunal Constitucional n.º 225/2018 é reflexo da controvérsia do tema, nomeadamente das problemáticas associadas à admissibilidade e ao regime jurídico da gestação de substituição. Adicionalmente, os perigos, riscos e consequências da prática da gestação de substituição transfronteiriça têm despertado cada vez mais o interesse e a preocupação de instituições e organizações europeias e internacionais, debatendo-se a necessidade e urgência dos Estados legislarem (interna e internacionalmente) sobre o tema e, sobretudo, de garantirem os direitos da criança nascida na sequência de um contrato de gestação de substituição. Nesta medida, a jurisprudência do Tribunal Europeu dos Direitos do Homem contribuiu para uma mudança de paradigma no tratamento de algumas problemáticas da gestação de substituição, nomeadamente quanto ao reconhecimento de efeitos da filiação constituída em país estrangeiro. Neste contexto, propomos o estudo das problemáticas e desafios da gestação de substituição, desde os seus conceitos basilares aos argumentos favoráveis ou obstativos à sua prática, incluindo o regime jurídico na ordem jurídica portuguesa e a gestação de substituição transfronteiriça. Este estudo será auxiliado por legislação, doutrina e jurisprudência, nacional e estrangeira, a partir da qual tentaremos apresentar uma nova reflexão sobre o tema e apresentar algumas soluções.

This research aims to formulate, to think and to analyse the main issues and legal challenges triggered by surrogacy. Surrogacy poses challenges to traditional concepts, institutes or legal figures, such as Contract Law, Family Law and Fundamental Rights of all parties involved. In Portuguese legal system, the legislative changes introduced by Law No. 25/2016, of 22 August, raised the need for a new thinking on this issue. Constitutional Court Judgment no. 225/2018 reflects the controversy of the subject, namely the problems related to surrogacy's acceptability and its legal regime. Additionally, the dangers, risks and consequences of cross-border surrogacy have increasingly aroused the interest and concern of European and international institutions and organizations, which have been debating the need and urgency for States to legislate (nationally and internationally) on the matter and, above all, to guarantee the rights of the child born through surrogacy. Further, the jurisprudence of the European Court of Human Rights contributed to a paradigm shift in the treatment of some problems concerning surrogacy, in particular regarding the recognition of effects of parentage established in a foreign country. In this context, it is proposed the study of the problems and challenges of surrogacy, from its basic concepts to arguments in favour or against it, including the legal framework in the Portuguese legal system, as well as cross-border surrogacy. This study shall be supported by legislation, doctrine and national and foreign jurisprudence, from which a new reflection and some solutions will be presented.
