A proteção jurídica dos migrantes nas relações de trabalho no Brasil: um estudo a partir do modelo europeu baseado no princípio da não discriminação

Abstract

Trata-se de pesquisa científica realizada para a obtenção de título pelo Curso de Mestrado em Ciência Jurídica da Universidade do Vale do Itajaí́ – UNIVALI, inserindo-se na área de concentração “Fundamentos do Direito Positivo”, vinculando-se àlinha de pesquisa “Direito e Jurisdição”, com dupla titulação pela Universidade do Minho – UMinho/Portugal pelo Mestrado em Direito da União Europeia. A composição teórica tem por objetivo geral analisar a proteção jurídica dos migrantes nas relações de trabalho no Brasil sob a ótica do modelo da união europeia baseado no princípio da não discriminação. A pesquisa é dividida em três capítulos, sendo que o primeiro aborda sobre um breve histórico acerca da origem do trabalho, a legislação e direitos trabalhista no Brasil, seus princípios e a reforma ocorrida no ano de 2017. No segundo capítulo apresenta-se a temática da livre circulação de trabalhadores na União Europeia, o Direito Europeu e seus princípios regentes. Finaliza-se destacando o Regulamento nº 1.612/68, o qual dispõe sobre o regimento europeu aplicável aos trabalhadores migrantes. O capítulo 3 é dedicado a abordar os princípios e leis para impedir a discriminação do trabalhador migrante no Brasil a partir do modelo europeu. Ainda, explana-se sobre o já extinto Estatuto do Estrangeiro e a Lei de Migrações, retratando-se a questão dos migrantes internacionais na figura dos Haitianos. Ao final, discute-se sobre a aplicação do Princípio da Não Discriminação dos migrantes no Brasil a partir do modelo europeu. Quanto à Metodologia, registra-se que foi utilizado o método indutivo e utilizadas as técnicas da pesquisa bibliográfica, da categoria e do conceito operacional, levando em consideração os parâmetros adotados pelo PPCJ/UNIVALI.

This is scientific research carried out to obtain a title by the Master's Course in Legal Science at the University of Vale do Itajaí́- UNIVALI, within the area of concentration “Fundamentals of Positive Law”, linked to the research line “ Law and Jurisdiction ”, with a double degree from the University of Minho - UMinho / Portugal by the Master in Law of the European Union. The theoretical composition has the general objective of analyzing the legal protection of migrants in labor relations in Brazil from the perspective of the European Union model based on the principle of non-discrimination. The research is divided into three chapters, the first of which addresses a brief history of the origin of work, legislation and labor rights in Brazil, its principles and the reform that took place in 2017. The second chapter presents the theme freedom of movement for workers in the European Union, European law and its governing principles. It ends by highlighting Regulation No. 1.612 / 68, which provides for the European regulations applicable to migrant workers. Chapter 3 is dedicated to addressing the principles and laws to prevent discrimination against migrant workers in Brazil based on the European model. Still, it is explained about the already extinct Foreigner Statute and the Migration Law, portraying the issue of international migrants in the figure of Haitians. Finally, it discusses the application of the Principle of Non-Discrimination for migrants in Brazil based on the European model. As for the Methodology, it is registered that the inductive method was used and the techniques of bibliographic research, category and operational concept were used, taking into account the parameters adopted by PPCJ / UNIVALI.
