O consentimento informado dos menores nas intervenções de cirurgia plástica reconstrutiva e estética

Abstract

O estudo desenvolvido na presente dissertação de mestrado pretende ser uma reflexão em volta do consentimento informado dos menores nas intervenções médicas, mais concretamente no que respeita às intervenções de Cirurgia Plástica Reconstrutiva e Estética, por considerarmos um tema complexo, pertinente, atual, de grande ressonância social e sobre o qual não existe regulamentação específica. Dado tratar-se de uma intervenção médica especializada, abordaremos todas as questões relativas a este procedimento, no que respeita ao paciente menor e ao consentimento para a realização da mesma. Nessa medida, refletindo criticamente sobre esta problemática, iremos indagar quais os critérios que deverão definir a capacidade do menor, tanto para consentir uma intervenção médico-cirúrgica, como para a recusar, tentando conciliar o direito à saúde e o direito à autodeterminação do menor. Para percebermos a dimensão da questão em apreço, faremos uma pesquisa e análise das cirurgias plásticas reconstrutivas e estéticas mais realizadas em menores, a nível nacional e internacional, onde constataremos quais as mais procuradas: se as cirurgias para corrigir um problema corporal causado pelo desenvolvimento físico ou para se livrar de um trauma (cirurgia plástica reconstrutiva), se as cirurgias para transformar, ou reproduzir uma imagem (cirurgia estética). Não obstante estas intervenções cirúrgicas serem realizadas em menores, estes, muitas vezes, para além de não terem plena compreensão dos benefícios, dos seus efeitos, riscos e consequências, não se encontram nas idades indicadas pela medicina para o efeito. Assim, propomo-nos analisar a problemática que o consentimento prestado por menor levanta na prática da medicina, neste tipo de procedimento cirúrgico, pelo que, se tornará indispensável abordar as posições da doutrina, da jurisprudência e da deontologia médica sobre esta temática. Face ao exposto, faz-se pertinente aferir se o menor, em razão da idade, possui a capacidade de entendimento suficiente para consentir e, assim, entender os benefícios e consequências da intervenção médica, bem como da necessidade de refletir quanto a uma regulamentação específica respeitante ao objeto em análise.

The study developed in this master's thesis intends to be a reflection on the informed consent of minors in medical interventions, specifically with regard to Reconstructive and Aesthetic Plastic Surgery interventions, considering this a complex, pertinent, current, and great theme social resonance and for which there is no specific regulation. As this is a specialized medical intervention, we will address all issues relating to this procedure, with regard to the minor patient and the consent to carry out the same. To that extent, critically reflecting on this issue, we will ask what criteria should define the minor's ability, both to consent to a medical-surgical intervention, and to refuse it, trying to reconcile the minor's right to health and the minor's right to self-determination. To understand the dimension of the issue at hand, we will conduct a research and analysis of the most performed reconstructive and aesthetic plastic surgeries in minors, nationally and internationally, where we will find out which are the most sought after: whether the surgeries to correct a body problem caused by physical development or to get rid of trauma (reconstructive plastic surgery), whether surgeries to transform, or reproduce an image (aesthetic surgery). Although these surgical interventions are performed on minors, they often, in addition to not having a full understanding of the benefits, effects, risks and consequences, are not at the ages indicated by medicine for this purpose. Thus, we propose to analyze the issue that the consent given by minors raises in the practice of medicine, in this type of surgical procedure, so it will become essential to address the positions of doctrine, jurisprudence and medical deontology on this subject. In view of the above, it is pertinent to assess whether the minor, due to age, has sufficient understanding to consent and, thus, understand the benefits and consequences of medical intervention, as well as the need to reflect on a specific regulation concerning the object under analysis.
