A responsabilidade civil das plataformas da economia colaborativa

Abstract

A evolução dos fenómenos da economia colaborativa tem vindo a modificar a forma como as pessoas se relacionam entre si aos mais diversos níveis e contribuiu também para o surgimento de novas questões jurídicas relacionadas com a regulação da atividade desenvolvida pelas plataformas da economia colaborativa, aqui se incluindo a sua potencial responsabilidade civil perante os utilizadores que, em face da respetiva utilização, possam ter sofrido danos. Esta é a questão sobre a qual nos propomos debruçar, sendo que começaremos por analisar, de forma necessariamente breve, a crescente preocupação da União Europeia em relação à atividade desenvolvida por parte das plataformas da economia colaborativa em matéria de responsabilidade civil, passando de seguida para uma breve incursão no ordenamento jurídico português, com o objetivo de abordar as implicações do tema ao abrigo do sistema legal vigente.

The growing of the collaborative economy phenomena has been changing the way people relate to each other at the most diverse levels and has also contributed to the emergence of new legal issues related to the regulation of the activity developed by the collaborative economy platforms, including here their potential civil liability to users who may suffered damage. This is the question that is going to be addressed. After analysing, briefly, the growing concerns of the European Union regarding the activity developed by the collaborative economy platforms in matters of civil liability, the paper moves to a brief incursion into the Portuguese legal system, with the objective of addressing the implications of the theme under the current legal system.
