Resumo(s): | A presente dissertação propõe-se a estudar um dos temas mais sensíveis
da actualidade, nomeadamente atendendo à sua dimensão social, pois versa
sobre a protecção fiscal da família.
Justamente, partindo da ideia de que a família, por ser um grupo social
fundamental da sociedade, merece protecção por parte do Estado, a nossa
abordagem inicia-se pelo estudo do quadro jurídico que a reconhece, ao nível
do direito constitucional e do direito civil.
Feita essa aproximação ao tema, passamos à análise do lugar que a
família ocupa no sistema fiscal português, em concreto no âmbito do imposto
sobre o rendimento das pessoas singulares, especialmente debatendo qual o
conceito fiscal de família merecedor de protecção.
Neste seguimento, investigamos os diferentes modelos de tributação
familiar, a saber, o quociente conjugal, o quociente familiar e a tributação
separada, de modo a perspectivar qual o sistema que melhor se adapta ao
propósito proteccionista, sem descurar as premissas de igualdade e
neutralidade tributárias. Neste âmbito, estudamos ainda a configuração actual
das deduções à colecta e dos benefícios fiscais, tentando percepcionar qual a
protecção real e efectiva que proporcionam à instituição familiar.
Por último, e em reflexo directo do estudo realizado, coube-nos tecer
considerações sobre a utilização da via fiscal para a protecção da família, bem
como sobre o recente intento reformista do imposto sobre o rendimento das
pessoas singulares. This dissertation examines one of the most sensible subjects of nowadays, mainly due to its social dimension as it is related to the fiscal protection of the family. Starting from the idea that the family deserves support from the Government, as it is a main social group of the society, our approach starts with the study of the legal framework as the constitutional law and civil law are concerned. After the approach to the subject, we analysed the importance that the family takes on the Portuguese tax system as regards the personal income tax, debating especially which family tax concept is worthy of protection. As follows, we investigated the different models of family taxation, that is, the quotient for married couples or splitting, the family quotient and the separated taxation in order to prospect the best system to be adapted to the protectionism without disregarding the premises of equality and tax neutrality. Yet, we studied the actual configuration of tax deductions and tax benefits to know which real protection they give to the family. Finally, and related directly to the study, we made some considerations on the taxation for the family protection as well as the recent intention related to the tax reform on the personal income tax. |
