A violência doméstica em Angola: análise do regime jurídico angolano

Abstract

A violência doméstica é um dos problemas que a sociedade actual se depara. A violência doméstica, tem provocado um elevado número de vítimas na sua maioria mulheres colocando, deste modo, um enorme desafio aos estados no que concerne ao combate a este problema. Composta por três capítulos, nesta dissertação pretendemos proceder ao estudo deste fenómeno no contexto angolano. Assim, o foco deste trabalho é tentar perceber de que modo este tipo de violência se manifesta em Angola, sua classificação e tipos, quais os factores que poderão estar na sua origem e que consequências podemos observar na vítima, na sua família e na própria sociedade. Analisamos ainda o procedimento criminal, medidas e penas aplicadas no crime de violência doméstica bem como a obrigação de indemnização aplicável ao agente. Sendo o povo angolano um povo fortemente ligado às suas tradições e costumes, foi interessante também abordar a questão da violência doméstica no âmbito do direito costumeiro. Para além do estudo do problema em si, procedemos à análise da forma como o Estado e a própria sociedade civil têm intervindo nesta matéria.

Domestic violence is one of the problems that today's society is in. Domestic violence has provoked a large number of victims mostly women, thus putting a huge challenge on the part of the States regarding the fight against this problem. Made up of three chapters, in this dissertation we intend to study this phenomenon in the Angolan context. Thus, the focus of this work is to try to understand how this type of violence manifests itself in Angola, its classification and types of domestic violence, what factors may be in its origin and what consequences we can observe in the victim, in his family and In society itself. We also analyse the criminal procedure, measures and penalties applied in the crime of domestic violence and the obligation of compensation applicable to the agent. Being the Angolan people a people strongly linked to their traditions and customs, it was interesting also to address the issue of domestic violence under the ordinary right. In addition to the study of the problem itself, we examine how the state and the civil society itself have intervened in this matter.
