Resumo(s): | A presente Dissertação pretendeu traçar um retrato do procedimento de inspeção tributária e
aduaneira, considerando, para o efeito, o entendimento da jurisprudência vertido nos Acórdãos dos
Tribunais superiores, nomeadamente do STA e dos TCA.
Assim, tendo como pressuposto as decisões daqueles órgãos jurisdicionais, começámos por
analisar a marcha do procedimento alvo de estudo, bem como as vicissitudes que surgem ao longo do
seu desenvolvimento e que motivam o recurso de um dos seus intervenientes - a AT ou o contribuinte -,
à intervenção dos Tribunais. Nesta vertente, aferimos de quem pode partir a iniciativa para a prática
dos atos inspetivos: da AT, em regra no cumprimento dos ditames do PNAITA; ou a pedido do
contribuinte ou de terceiro que com aquele mantenha relações económicas que justifiquem a
caracterização da sua situação tributária. Em ambos os casos, os atos inspetivos são praticados pelos
órgãos da AT - embora esta possa recorrer à colaboração de entidades terceiras -, pelo que analisámos
a competência material dentro da orgânica daquela entidade.
Posteriormente, passámos a analisar as notificações efetuadas pela AT ao sujeito passivo no
decurso do procedimento de inspeção tributária e aduaneira, em concreto, a notificação prévia, bem
como os casos em que é dispensada, a notificação do despacho responsável por alterar os fins e a
extensão do procedimento e, por fim, a notificação para o exercício do direito de audição prévia.
De seguida, centrámo-nos nos prazos para a prática e conclusão do procedimento de inspeção
tributária e aduaneira, assumindo especial relevo a suspensão do prazo de caducidade do direito à
liquidação, operada pela notificação ao contribuinte da inspeção externa.
Terminámos a análise da marcha do procedimento com uma referência ao relatório de
inspeção, bem como à natureza jurídica deste e de outros atos inspetivos adotados pela AT.
Na parte final da Dissertação, abordámos a suscetibilidade de os atos inspetivos colocarem em
causa os direitos do contribuinte visado no procedimento, em especial quando a AT acede a dados
sobre a sua vida íntima, nomeadamente por meio de intromissões no domicílio, na correspondência e
através da derrogação do sigilo bancário. Por último, analisámos a posição do órgão máximo da
jurisdição constitucional portuguesa acerca do direito à não auto-incriminação do contribuinte. The present Dissertation intended to trace a portrait of the tax and customs inspection procedure, considering, for this purpose, the understanding of the jurisprudence declared in the judgments of the Higher Courts, specifically the Portuguese Supreme Administrative Court and Central Administrative Courts. Thus, taking the decisions of those jurisdictions as a premise, we began, in a first plan, to analyze the progress of the procedure under study, as well as the vicissitudes that emerge throughout its development and that motivate the appeal of one of its intervening - the Tax Authority or the taxpayer - to the intervention of the Courts. In this regard, we have initiated the study for the practice of inspection acts, which can start from the Tax Authority, as a rule, in compliance with the rules of National Plan of Tax and Customs Inspection Activities, or occur at the request of the taxpayer or of a third party who maintains economic relations with the taxpayer that justify the characterization of their tax situation. In both cases, the inspection acts are performed by the organs of Tax Authority - although they may resort to the collaboration of third party entities - so we have analyzed the material competence within the organization of that entity. Subsequently, we began to analyze the notifications made by Tax Authority to the taxpayer during the tax and customs inspection procedure, specifically the prior notification, as well as the cases in which it is dispensed with, the notification of the order responsible for changing the purposes and extension of the procedure and, finally, the notification for the exercise of the right of prior audition. Then, we focused on the deadlines for the practice and conclusion of the procedure of tax and customs inspection, with special emphasis on the suspension of the expiring right to liquidation, operated by the notification to the taxpayer of the external inspection. We finished the analysis of the progress of the procedure with a reference to the inspection report, as well as the juridical nature of this and other inspection acts adopted by Tax Authority. In the final part of the Dissertation, we addressed the inspection acts that may compromise the rights of the taxpayer targeted by the procedure, in particular the cases in which Tax Authority may access data about its private life, specifically through home intrusions, in correspondence and through the derogation of bank secrecy. Finally, we analyzed the position of the highest Court of the Portuguese Constitutional Jurisdiction regarding the right of the taxpayer not to self-incrimination. |
