Resumo(s): | A presente dissertação tem como escopo a consciencialização da não audição das crianças
pelas instâncias judiciais, no âmbito da regulação do exercício das responsabilidades parentais.
Aliada a um reflexo do desrespeito pelo critério do superior interesse da criança.
Não obstante a preocupação do nosso legislador em salvaguardar a efetivação deste direito
supranacional através da sua consagração no nosso ordenamento jurídico, mais concretamente,
no art. 35º, n.º 3, do RGPTC, a prática dos nossos Tribunais tem vindo a contrariar a tendência
da evolução legislativa e, consequentemente, dos direitos das crianças.
Sob o olhar atento e crítico procuraremos dar voz ao real problema da não audição analisando
a questão na sua raiz. Dito de outro modo, ainda que sucinto, indagaremos o impacto que o
divórcio representa na vida das crianças. De que modo se efetiva o critério do superior interesse
da criança, nos casos de regulação do exercício das responsabilidades parentais. E, ainda, de que
forma o direito de audição é percecionado pelos nossos julgadores.
Estaremos nós, em pleno século XXI, vinculados a um passado patriarcal e poderoso, no qual
as vozes das crianças não se conseguem ouvir? Onde as suas vozes não passam do exarado nos
mais diversos diplomas, nacionais e internacionais, onde se proclama o direito de audição das
crianças? Será a voz das crianças, uma voz silenciada?
Estas serão apenas três das várias questões que procuraremos encontrar resposta e dar a voz
a quem a detém por direito – as crianças! The intention of this dissertation is to raise awareness of the fact that, within the context of the Regulation of the Exercise of Parental Responsibilities, children are not heard by judicial bodies. This combines with a disregard and lack of respect for the criteria in the child's best interest. Despite the concern of our legislator to safeguard the enforcement of this multinational right through its conservation in our legal system, more specifically, in article 35, n.º 3, of the RGPTC, the practice of our courts has been contrary to the trend of legislative evolution and, consequently, to the rights of children. Under a careful and critical eye, we will seek to express the real problem of non hearing children by analysing the issue at its core. In other words, although brief, we will investigate the impact that divorce has on children’s lives. How does the criteria represent the best interests of the child and how is it implemented in cases of Regulation of the Exercise of Parental Responsibilities. In addition, how the right to be heard is perceived by our judges. Are we, in the twenty-first century, bound by a patriarchal and powerful past in which children's voices cannot be heard? Where do their voices go beyond what is expressed in the most unique statutes, national and International, where the right of a hearing for children is stated? Is the children’s voice a silenced voice? These are only three of the many questions that we will try to find an answer and give a voice to those who rightfully own it – the children! |
