Resumo(s): | A presente investigação visa provocar reflexões sobre o abuso do direito no exercício das
responsabilidades parentais na perspectiva do superior interesse da criança. O processo histórico de
reconhecimento das crianças enquanto sujeitos de direitos foi longo e árduo, tendo a Convenção
Internacional sobre os Direitos da Criança o papel de divisor de águas neste processo. Com o advento
da Convenção sobre os Direitos da Criança e a adesão de 196 países, na esfera interna os países
passaram a tratar a criança de forma privilegiada. Em Portugal, a legislação que tem a criança como
destinatário tem cariz protetivo fortalecido. Neste cenário que coaduna normas internacionais de
direitos humanos e normas internas, somado à eficácia dos direitos fundamentais entre particulares,
tem-se a possibilidade de uma nova hermenêutica do direito das famílias que coloca o superior
interesse da criança como questão fundamental a ser considerada. Neste sentido, as
responsabilidades parentais que historicamente correspondiam ao poder paternal, passaram a se
constituir em poderes-dever de caráter protetivo e altruísta, de atendimento ao superior interesse da
criança. Deste modo, o exercício das responsabilidades parentais deve ser pautado não apenas por
comportamentos legalmente conformados mas também pelo superior interesse da criança,
especialmente quando houver conflito de interesses entre as crianças e os progenitores. É neste
cenário que convém analisar o instituto do abuso do direito. Considerado como o exercício de um
direito que viola a boa fé, os bons costumes ou os fins econômicos e sociais, o abuso do direito
configura uma ilicitude cujas consequências aos autores podem ser as mais variadas e, via de regra,
possibilitam que haja uma pretensão indenizatória daqueles que foram vitimados. Nos casos de
exercício abusivo das responsabilidades parentais, é possível constatar que a legislação prevê
consequências tão graves quanto a inibição ou limitação do exercício das responsabilidades parentais,
aplicação de medidas de proteção dentre outras. Considerando situações específicas que pautam o
atual debate sobre os direitos da criança, analisa-se situações como a exposição da criança à violência
doméstica, alienação parental e exposição da imagem da criança na internet e outras mídias sob a
ótica do abuso do direito e do superior interesse da criança. The present investigation aims to provoke reflections on the abuse of rights in the exercise of parental responsibilities from the perspective of the best interests of the child. The historical process of recognizing children as subjects of rights was long and arduous, and the International Convention on the Rights of the Child had the role of watershed. With the advent of the Convention on the Rights of the Child and the accession of 196 countries, in the internal sphere, countries started to treat children in a privileged way. In Portugal, the legislation that has children as subjects has a strengthened it’s protective nature. In this scenario that combines international human rights and internal norms, in addition to the effectiveness of fundamental rights between individuals, it is possibble to consider a new hermeneutics of family law that places the best interests of the child as a fundamental issue to be considered. In this sense, parental responsibilities that historically corresponded to parental authority, began to constitute duty-powers of protective and altruistic nature, serving to the best interests of the child. In this way, the exercise of parental responsibilities must be guided not only by legally compliant behaviors but also by the best interests of the child, especially when there is a conflict of interest between the children and the parents. It is in this scenario that it is convenient to analyze the institute of abuse of rights. Considered as the exercise of a right that violates good faith, good customs or economic and social purposes, the abuse of the right constitutes an illegality whose consequences to authors can be the most varied and possibly allow for a claim to indemnify those who were victimized. in cases of abusive exercise of parental responsibilities, the legislation provides consequences as serious as the inhibition or limitation of the exercise of parental responsibilities, application of protective measures, among others. Considering specific situations that guide the current debate on the rights of the child, situations such as the child's exposure to domestic violence, parental alienation and exposure of the child's image on the internet and other media are analyzed from the perspective of the abuse of rights and best interest of the child. |
