A regulamentação jurídica internacional e europeia da economia colaborativa

Abstract

As grandes plataformas da economia colaborativa que operam online utilizam o mercado digital global para oferecer melhores preços ou disponibilizar uma oferta variada de produtos e serviços, obtendo uma abrangência mundial. A dimensão económica e mediática e o poder de influência destas plataformas são tão elevados que, frequentemente, tentam condicionar as opções legislativas dos Estados. Nesta medida, face a estas plataformas que operam no mercado digital global, é relevante analisar se existem instrumentos internacionais que regulamentem as atividades destas plataformas. Esta característica de internacionalidade e a influência para moldar o mercado das grandes plataformas da economia colaborativa também levaram a União Europeia a lançar um olhar regulatório para as atividades da economia colaborativa, de forma a integrá-las no mercado único digital. Ora, é a regulamentação internacional uniforme da economia colaborativa que passaremos a analisar, numa primeira fase, no plano internacional e, numa segunda fase, no plano da União Europeia.

The large platforms of the collaborative economy that operate online use the global digital market to offer better prices or a varied offer of products and services, obtaining a worldwide range. The economic and media dimension and the power of influence of these platforms are so high that they often try to condition the legislative options of States. Taking into consideration these platforms that operate in the global digital market, it is relevant to analyse whether there are international instruments that regulate the activities of these platforms. This characteristic of internationality and the influence to shape the market by the large platforms of the collaborative economy also led the European Union to take a regulatory look at the activities of the collaborative economy, in order to integrate them into the digital single market. It is the uniform international regulation of the collaborative economy that we will begin to analyse, in a first phase, at the international level and, in a second phase, at the European Union level.
