dc.description.abstractNa presente dissertação, avaliaremos a importância da constituição do arguido, bem como dos direitos e deveres que se seguem aquando do estabelecimento do seu estatuto processual e como estes se poderão relacionar diretamente com o princípio nemo tenetur se ipsum accusare, expressão latina para o direito à não autoincriminação. Para que possamos explicar a ligação existente entre o arguido e o seu papel no processo, com o seu direito ao silêncio e à autoincriminação, optamos por dividir este projeto em três capítulos distintos. Primeiramente, passaremos por tratar da estrutura do processo penal português e como esta evoluiu ao longo da História, importante para conceber o papel do arguido nesta. A menção feita ao art. 32º, n.º5 da CRP é igualmente útil para compreendermos como o nosso texto constitucional acolhe o arguido e os seus direitos, cujo resguardo será vital para o desenvolvimento dos atos processuais. Ademais, mencionaremos também os princípios processuais e constitucionais que relevarão para o arguido, figura principal deste nosso projeto. Em segundo lugar, considerando que o arguido é uma peça fundamental para a colheita de elementos probatórios, faremos um breve enquadramento da prova no nosso sistema processual penal e de como ela poderá ser apreciada no mesmo. Não obstante, para que o possamos considerar como meio de prova, é necessário que este se constitua como arguido efetivamente. Passaremos por mencionar todo o processo, juntamente com os direitos e deveres que adquire pelo caminho, especialmente o direito ao silêncio. Caso este decida não salvaguardar o seu conhecimento, a confissão será a opção principal, que poderá vir acompanhada do seu devido arrependimento, embora se definam como conceitos diferentes. Nos momentos em que esta sua confissão reúna as condições necessárias, poderá, em, alguns ordenamentos, ser premiada, ponto que achamos relevante abordar. Por fim, trataremos do princípio nemo tenetur se ipsum accusare – da sua origem, do seu âmbito e dos seus limites, de como este não se insere em textos legalmente previstos, mas ainda assim concretiza uma figura de extrema importância para a doutrina e a jurisprudência e, ainda, de como este se pode apresentar como útil para o arguido. Terminaremos este projeto com uma breve ponderação, debatendo se é mais vantajoso o arguido escolher seguir o silêncio ou se será mais benéfico compartilhar tudo o que sabe mediante as suas declarações.por
dc.description.abstractIn this dissertation, we will evaluate the importance of the defendant's constitution, as well as the rights and duties that follow when establishing their procedural status and how these can be directly related to the principle nemo tenetur se ipsum accusare, a Latin expression for the right against self incrimination. So that we can explain the connection between the defendant and their role during the process, with their right to remain silent and not self-incriminate, we chose to divide this project into three distinct chapters. Firstly, we will discuss the structure of the Portuguese criminal process and how it has evolved throughout history, which is important for understanding the role of the defendant in it. The mention made to article 32, n.º5 of the Portuguese Constitution is also useful for us to comprehend how our constitutional text embraces the defendant and their rights, the protection of which will be vital for the development of procedural acts. Furthermore, we will also mention the procedural and constitutional principles that will be relevant to the defendant, the main figure of our project. Secondly, considering that the defendant is a fundamental element in the gathering of evidence, we will briefly frame the evidence itself in our criminal procedural system and how it can be assessed there. However, in order for us to consider the defendant as an evidence themself, it is also necessary that they are effectively constituted as a defendant in legal matters. We will mention the entire process, in addition to the rights and duties acquired by the defendant along the way, especially the right to remain silent. If he decides not to gatekeep his knowledge, confession will be the main option, which may be accompanied by due repentance, although they are defined as different concepts. At times when your confession meets the necessary conditions, it may, in some legal systems, be awarded, a point that we believe to be important to address. Finally, we will deal with the nemo tenetur se ipsum accusare principle – its origin, its scope and its limits, how it is not included in legally stipulated texts, but still represents a figure of extreme importance for doctrine and jurisprudence. and also how this can be useful for the defendant. We will end this project with a brief consideration, debating whether it is more advantageous for the defendant to choose to remain silent or whether it will be more beneficial to share everything he knows through his statements, even if that means to go against his self-right to not incriminate.por
