dc.description.abstractEsta dissertação aponta, numa primeira fase, as mudanças sofridas no normativo do art.164.º do Código Penal, no ordenamento jurídico português, como também a evolução do tipo legal do crime de violação em outros ordenamentos jurídicos e menciona ainda os documentos legislativos internacionais que tiveram influência nessas mesmas mudanças e que são de grande importância para o tema que aqui é tratado. Destaca-se a nível internacional a Convenção de Istambul, que Portugal ratificou, tendo de adequar a sua legislação interna, aos compromissos que assumiu com a sua ratificação. É possível, no âmbito do crime de violação, referir três modelos que o legislador pode adotar. São eles, o modelo de constrangimento, o modelo de dissentimento e o modelo de consentimento. Por isso, será feita uma caracterização destes modelos, remetendo-se para outros ordenamentos jurídicos onde cada um deles vigora. Por fim, importa saber qual é o modelo seguido por Portugal. Para isso proceder-se-á a uma análise do, atual, art.164.º Código Penal, com vista a desmitificar o modelo seguido.por
dc.description.abstractInitially, this dissertation points out the changes that have taken place in Article 164 of the Penal Code in the Portuguese legal system, as well as the evolution of the legal type of rape crime in other legal systems. It also mentions the international legislative documents that have had an influence on these changes and which are of great importance to the subject being dealt with here. At an international level, the Istanbul Convention stands out, which Portugal ratified, having to adapt its domestic legislation to the commitments it undertook with its ratification. In the context of the crime of rape, there are three models that the legislator can adopt. These are the constraint model, the dissent model and the consent model. These models will therefore be characterized, with reference to other legal systems where each one is in force. Finally, it is important to know which model Portugal follows. This will be done by analyzing the current Article 164 of the Penal Code, with a view to demystifying the model followed.por
