| dc.description.abstract | A identidade de género é uma das componentes fundamentais para identidade de cada ser humano. A Constituição da República Portuguesa reconhece a identidade pessoal como sendo um direito fundamental de todas as pessoas e institui como seus valores estruturais a dignidade da pessoa humana e a igualdade de direitos de todos os cidadãos. Em Portugal, com a aprovação da Lei n.º 38/2018, de 7 de agosto, passou a consagrar-se expressamente o direito à autodeterminação da identidade de género, impondo-se um modelo de reconhecimento legal fundado na autodeterminação de cada pessoa. Não obstante, este diploma legal exclui deste acesso as identidades de género não binárias, na medida em que apenas reconhece identidades binárias. Considerando a importância de cada pessoa viver, livremente e em condições de igualdade a sua identidade autodeterminada, e sabendo que às pessoas de identidade de género não binária não é reconhecida legalmente a sua identidade, a presente dissertação indaga de que forma o Direito português está ou não a assegurar o acesso a uma existência digna das pessoas de identidade de género não binária. Na nossa análise, além daquilo que é estatuído na ordem jurídica portuguesa, será também tido em consideração o disposto na matéria pelo Direito Internacional dos Direitos Humanos, reconhecendo-se a sua importância e influência a nível nacional. A temática da autodeterminação de género e do reconhecimento legal de identidades não binárias tem vindo cada vez mais a ser tema no plano internacional e existem já ordenamentos jurídicos estrangeiros que consagram modelos de reconhecimento não binário. Tendo em conta a importância do Direito Comparado, será feita uma análise em perspetiva comparada de diferentes modelos de reconhecimento legal de género na Europa. | por |
| dc.description.abstract | Gender Identity is one of the most important and intrinsic dimensions of every human being’s identity. The Constitution of the Portuguese Republic recognizes personal identity as a fundamental right of all people, and establishes as structural values the dignity of the human person and the equal rights of all citizens. In Portugal, with the approval of Law No. 38/2018, the right to self-determination of gender identity was expressly enshrined, imposing a model of gender legal recognition based on the self-determination of each person. However, this legal diploma excludes non-binary gender identities from having access to it, as it only recognizes binary identities. Considering the importance of each person living, freely and in equal conditions, their self-defined identity, and knowing that people of non-binary gender identity are not legally recognized, this dissertation inquires how Portuguese law is or is not ensuring access to a dignified existence for people of non-binary gender identity. In this analysis, in addition to what is established in the Portuguese legal order, the provisions of International Human Rights Law will also be taken into account, recognizing its importance and influence at the national level. The theme of gender self-determination and the legal recognition of non-binary identities has been increasingly discussed at an international level and there are already foreign legal systems that establish non-binary gender recognition models. Recognizing the importance of comparative law, a comparative analysis of different models of legal gender recognition in Europe will be made. | por |
