| dc.description.abstract | A integração de novas tecnologias no setor financeiro tem instigado profundas alterações nos modelos de negócios e na forma de acesso aos serviços. Os Robot-advisors – plataformas digitais que providenciam aconselhamento financeiro mediante algoritmos de IA – são um exemplo claro disso. Estes novos “atores” no mercado mobiliário estão em franco crescimento e surgem como uma alternativa de baixo custo aos tradicionais serviços de investimento. Não obstante as inegáveis vantagens, estas plataformas levantam novos e desafiantes problemas ao Direito. Nos últimos anos, o debate em torno deste novo fenómeno tem-se centrado, sobretudo, no quadro regulamentar a disponibilizar. A presente dissertação dedica-se, por outro lado, ao estudo da responsabilidade civil por danos causados por Robot-advisors. O escopo da investigação passa precisamente por descortinar se um investidor pode ou não obter uma indemnização por um conselho ou decisão de investimento gerada por um Robot-advisor e a quem poderá ser imputada a obrigação de ressarcimento. Com vista a dar solução àqueles problemas, a investigação percorrerá dois caminhos paralelos. Por um lado, analisaremos o enquadramento jurídico a ser disponibilizado àqueles robots e, por outro, lidaremos com a miríade de questões que podem ser levantadas no âmbito da aplicação das regras de responsabilidade civil. Partindo-se da análise do direito constituído, indicaremos algumas fragilidades que se detetam neste plano, e refletiremos sobre as perspetivas da evolução jurídica que se conjeturam, especialmente no âmbito do direito da União Europeia. | dc.description.abstract | The integration of new technologies in the financial sector has instigated deep alterations to business models and forms of access to services. Robot-advisors – digital platforms that provide financial counseling through AI algorithms – are a clear example of that. These new “actors” in the securities market are in weak growth and they emerge as a low-cost alternative to traditional investment services. Despite the undeniable advantages, these platforms raise new and challenging problems for civil law. In the last few years, the debate around this new phenomenon has centered mainly on the regulatory framework to be made available. The present dissertation is, however, dedicated to the study of civil responsibility for damages caused by Robot-advisors. The scope of the investigation goes precisely by unveiling if an investor can get an indemnity for a piece of advice or investment generated by a Robot advisor and to whom the obligation of reimbursement may be imputed. In order to solve these problems, the investigation will run two paths. On the one hand, we’ll analyze the legal framework to be made available for those robots and, on the other hand, we will deal with the myriad of questions that can be raised within the scope of the application of civil liability rules. Based on the analysis of the constituted law, we will indicate some weaknesses that were detected in this plan, and we´ll reflect on the perspectives of legal evolution that are conjectured, especially within the framework of the European Union law.
