dc.description.abstractA presente dissertação tem por objeto de estudo o direito comparado entre os ordenamentos jurídicos português e brasileiro referente à prática da residência alternada da criança no contexto de pós-divórcio ou separação dos pais. Com essa finalidade, analisou-se a viabilidade jurídica desta modalidade de residência em ambos os países, bem como as vantagens da aplicação deste modelo, de forma a priorizar sempre o superior interesse da criança. Antes de adentrar diretamente no tema em questão, foi examinada a evolução da dinâmica familiar, origem da residência alternada nos Estados Unidos da América e o Princípio do Superior Interesse da Criança. Em um segundo momento, dedicou-se um capítulo para o estudo da residência alternada no ordenamento jurídico português, discorrendo sobre as alterações legislativas, antes e depois da Lei nº. 61/2008, análise do artigo 1906.º do Código Civil Português, especialmente o número 6 deste artigo, bem como decisões dos tribunais portugueses sobre o tema ora proposto. No capítulo seguinte, examinou-se a residência alternada na legislação brasileira, momento em que foi tratado sobre o poder familiar, modalidades de guarda admitidas pelo Código Civil de 2002 e, por fim, acórdãos de diversos tribunais brasileiros a respeito do tema. O último capítulo destinou-se ao estudo dos casos de inaplicabilidade da residência alternada, os argumentos dos doutrinadores contrários ao instituto, bem como o papel da mediação familiar e sua possível maisvalia com relação à temática ora proposta.por
dc.description.abstractThe present dissertation aims to study the comparative law between the Portuguese and Brazilian legal systems about the practice of shared residence of the child after divorce or separation. For this purpose, the legal feasibility of this type of residence was analyzed in both countries, as well as the advantages of applying this model, always prioritizing the best interests of the child. Before addressing the topic in question directly, the evolution of family dynamics, the origin of alternating residence in the United States of America and the Principle of the Best Interest of the Child were examined. In a subsequent section, a chapter was dedicated to the study of alternating residence in the Portuguese legal system, discussing the legislative changes, before and after Law n.º 61/2008, analysis of article 1906.º of the Portuguese Civil Code, especially number 6 of this article, as well as decisions of Portuguese courts on the proposed topic. In the following chapter, alternating residence in Brazilian legislation was examined, at which point family power, the types of custody permitted by the Civil Code of 2002 and, finally, rulings from various Brazilian courts regarding the topic were addressed. The last chapter is devoted to studying where alternating residence is inapplicable, the arguments of scholars opposed to the institute, as well as the role of family mediation and its possible added value in relation to this study.por
