dc.description.abstractComeçaremos por fazer uma apresentação do tema, introduzir conceitos básicos relativos aos criptoativos e uma introdução histórica de como surgiram os criptoativos e toda a sua envolvência até chegarmos à Bitcoin que se pode considerar o ponto de viragem nestes temas. Pretende-se mostrar qual a abordagem fiscal antes das alterações fiscais para 2023 que vieram tentar colmatar um grande vazio fiscal que existia no nosso ordenamento jurídico. Daremos um destaque quanto à qualificação como valores mobiliários ou não como uma questão que terá um grande impacto para a tributação, utilizando quatro criptoativos relevantes, expondo as caraterísticas das mesmas como exemplo e discussão fazendo uso do caso mais relevante a este respeito nos tribunais dos Estados Unidos e mostrar como o mesmo pode servir de orientação interpretativa para enquadrar as criptomoedas em Portugal. De seguida, será feita uma dissecação dos pontos mais relevantes das alterações fiscais para 2023 procurando fazer uma interpretação das mesmas e recuperando o que anteriormente expusemos quanto à qualificação para interligar às implicações práticas fiscais portuguesas e tentando sugerir mudanças mencionando outras formas de agir em outros países dando ainda atenção aos desafios no domínio tributário. Vamos fazer uma análise prática de como a tributação pode ser eficaz abordando a rastreabilidade da blockchain e como os mecanismos de combate ao branqueamento de capitais/financiamento do terrorismo e investigação de blockchain podem ser usados e adaptados para o contexto fiscal, mostrando de que forma os contribuintes podem tentar ocultar os seus rendimentos e mostrar como se pode impedir que isso aconteça.por
dc.description.abstractWe'll begin by introducing the topic, basic concepts relating to cryptoassets, as well as a historical introduction to how cryptoassets came about and all their implications until we reach Bitcoin, which can be considered the turning point in these issues. The aim is to show what the tax approach was before the tax changes for 2023, which attempted to fill a major tax gap in our legal system. We will highlight whether or not cryptocurrencies qualify as securities as an issue that will have a major impact on taxation, using four relevant cryptoassets, exposing their characteristics as an example and discussion, using the most relevant case in this regard in the courts of the United States and showing how it can serve as an interpretative guideline for framing cryptocurrencies in Portugal. Next, we will dissect the most relevant points of the tax changes for 2023 in an attempt to interpret them and recover what we have previously said about qualification in order to link it to the practical implications of Portuguese taxation and try to suggest changes by mentioning other ways of acting in other countries, while also paying attention to the challenges in the tax field. We will make a practical analysis of how taxation can be effective by addressing blockchain traceability and how anti-money laundering/terrorist financing mechanisms and blockchain investigation can be used and adapted to the tax context, showing how taxpayers can try to hide their income and showing how this can be prevented.por
