As Políticas Públicas de Saúde em Portugal: a Tutela do Ambiente como instrumento de concretização

Abstract

A escolha e delimitação do objeto desta dissertação teve como desiderato o aprofundamento do estudo da relação entre o Ambiente e a Saúde de uma perspetiva jurídica, explorando a forma como estes se entrecruzam e as implicações que daí derivam. Para que tal acontecesse, iniciámos a nossa análise com um enquadramento histórico do nosso Sistema de Saúde, abordando marcos essenciais nessa evolução, como o nascimento do Serviço Nacional de Saúde e os subsequentes movimentos de privatização que ocorreram na saúde, nomeadamente a aproximação da sua gestão a moldes empresariais e, principalmente, a criação de Hospitais E.P.E., integrados no Sector Empresarial do Estado. Após esta incursão sobre aquele que foi o percurso histórico do nosso Sistema de Saúde, em que aproveitamos para pôr em evidência as principais críticas e fragilidades dos regimes jurídicos estabelecidos em torno dessas mudanças, focamo-nos no momento presente, sobre o qual procuramos recorrer a uma análise multidisciplinar do conceito de saúde. Deste modo, e em consonância com a visão internacionalmente aceite, estabelecemos como ponto de partida para a análise das Políticas Públicas de Saúde os Determinantes Sociais da Saúde, ou seja, os fatores que afetam a nossa saúde individual e coletiva, colocando o acento tónico na Promoção da Saúde e Prevenção da Doença. Ainda que se tenha discorrido sobre os mais importantes, razões práticas relacionadas com o limite temporal e espacial a que o presente estudo estava sujeito conduziram à análise exaustiva de apenas um deles, o fator ambiental. Assim, chegamos ao busílis da nossa análise: a implicação do fator Ambiente e o peso que este deve ter no momento da formulação e implementação de Políticas Públicas de Saúde. Advogamos, portanto, que uma tutela ambiental efetiva poderá trazer benefícios significativos em vários quadrantes, nomeadamente no que concerne com a Prevenção da Doença. Paralelamente, abordámos questões relacionadas com a própria sustentabilidade do Serviço Nacional de Saúde, recuperando a ideia de que uma mudança de paradigma que foque o momento prévio ao aparecimento da doença, por outras palavras, de pendor preventivo, trará ganhos significativos também neste domínio.

The choice and delimitation of the object of this dissertation had the goal of studying in depth the relationship between Environment and Health in a legal perspective, exploring the way they intertwine and the implications that derive from the intertwining. First, we started our analysis with a historical framework of our Health System, addressing key milestones in its evolution. For example, the creation of the National Health Service and the subsequent privatization movements that occurred in health, namely the approximation of its management to business models and the creation of a public hospitals entity, owned by the Portuguese Government. After the description of the historical framework of our Health System, in which we took the opportunity to highlight the main criticisms and weaknesses of the legal regimes established around these changes, we focus on the present moment, on which we use a multidisciplinary analysis of the concept of health. Accordingly with the internationally accepted view, we established the Social Determinants of Health as a starting point for the analysis of Public Health Policies. Like that, we discuss the factors that affect our individual and collective health, highlighting the promotion of health and disease prevention. Although the most important factors were discussed, practical reasons related mainly to the temporal and spatial limit of the present study led to the exhaustive analysis of only one of them, the Environmental factor. Thus, we come to the center of our analysis - the implication of the factor Environment and the weight it must have during the elaboration and implementation of Public Health Policies. We advocate, therefore, that effective environmental protection can bring significant benefits in several sectors, focusing the benefits related to Disease Prevention. In parallel, we address issues related to the sustainability of the National Health Service, mentioning that a focuses on the moment prior to the outbreak of the disease (a preventive approach), will bring significant gains in this area.
