dc.description.abstractA Saúde e meios tecnológicos revelam-se dois temas extremamente importantes para o Estado e para a sociedade civil. No pretérito reconhecia-se à área da saúde e à área tecnológica uma relação quase inexistente. Atualmente, os robôs dotados de Inteligência Artificial são autónomos e capazes de tomar as suas próprias decisões, pelo que a sociedade reconhece uma notória evolução nesta área, reconhecendo também a crescente utilização de tecnologias no quotidiano do cidadão, mormente na área da saúde. Os casos de responsabilidade médica só mais recentemente começaram a ser debatidos nos Tribunais e as condenações se tornaram mais frequentes. Por outro lado, é notória a progressiva incorporação da IA nas mais variadas atividades e, de facto, a área da saúde não ficou indiferente, almejando na intervenção destes sistemas inteligentes reduzir os custos e garantir uma melhor qualidade de prestação nos cuidados de saúde. Neste ensejo, evidencia-se que a interação entre os agentes autónomos e a medicina é uma realidade cada vez mais constante, pelo que deve o Direito adaptar-se às novas realidades sociais. Com o exposto se relaciona, assim, a nossa vontade de tratar este tema, através da apreciação, análise e problematização de questões como a responsabilidade civil dos médicos por atos por si praticados e a responsabilidade dos agentes autónomos. O tema é complexo e delicado, pelo que não temos o intuito de resolvê-lo. Pretende-se, pois, analisar as possíveis soluções do ordenamento jurídico português, analisando a aptidão destas para os danos provocados por erros médicos e sistemas dotados de Inteligência Artificial.por
dc.description.abstractHealth and technological means are two extremely important issues for the government and for civil society. In the past, the health area and the technological area were recognized as having an almost non-existent relationship. Currently, robots equipped with Artificial Intelligence are autonomous and capable of making their own decisions, so society recognizes a notorious evolution in this area, also recognizing the growing use of technologies in the daily life of citizens, especially in the area of health. Medical liability cases have only recently begun to be debated in the courts and convictions have become more frequent. On the other hand, the progressive incorporation of AI in the most varied activities is notorious and, in fact, the health area was not indifferent, aiming to reduce costs and ensure a better quality of health care provision in the intervention of these intelligent systems. So, as I mentioned, it is evident that the interaction between autonomous agents and medicine is an increasingly constant reality, so the Law must adapt to the new social realities. This is related to our desire to address this issue through the appreciation, analysis and problematization of issues such as the civil liability of physicians for acts performed by them and the liability of autonomous agents. The subject is complex and delicate, so we do not intend to solve it. It is intended, therefore, to analyze the possible solutions of the Portuguese legal system, analyzing their suitability for the damages caused by medical errors and systems equipped with Artificial Intelligence.por
