dc.description.abstractO objetivo da presente dissertação é motivar a reflexão em torno de um muito interessante instrumento de cooperação judiciária em matéria penal na União Europeia: a Decisão Europeia de Investigação (DEI). Contextualizando-o num cenário que há muito pede um mecanismo que venha agilizar a prevenção e repressão de práticas criminais que beneficiam das fronteiras entre os Estados, cogitamos se a sua aplicação resulta numa maior proteção dos direitos fundamentais, ou numa sua maior exposição a lesões em seio de produção de prova. Mantendo a proteção dos direitos fundamentais como mote – e, aliás, preocupação assumida desde sempre pela União Europeia –, suspeitamos que a sua garantia pudesse ser mais devidamente acautelada se a criação da DEI tivesse sido antecedida de uma maturada e assumida política criminal europeia. Face à ausência desta última, encontramo-nos num contexto em que se fazem cruzar direitos processuais penais incompatíveis em questões tão acutilantemente relacionadas com a proteção dos direitos fundamentais como as proibições de produção de prova. Permitimo-nos indagar sobre a possibilidade de estarmos perante um novo limite ao efeito-à-distância – não formalmente reconhecido, mas praticamente implicado. A dificuldade prática de sindicância da devida produção de prova levada a cabo numa jurisdição estrangeira potencia a admissibilidade de material probatório produzido em desconformidade com as regras processuais do Estado onde o processo penal em questão corre termos. Detetado este problema, ambicionamos, então, aproximarmo-nos de um desfecho que permita um melhor equilíbrio entre a sofisticação de que se tem vindo a dotar a repressão penal, e a defesa da posição do arguido em processos penais transnacionais.por
dc.description.abstractThe aim of this dissertation is to motivate reflection around a very interesting instrument of judicial cooperation in criminal matters in the European Union: the European Investigation Order (EIO). Contextualizing it in a scenario that has long asked for a mechanism that will speed up the prevention and repression of criminal practices that benefit from the borders between States, we consider whether its application results in greater protection of fundamental rights, or in its greater exposure to injuries in evidence gathering. Keeping the protection of fundamental rights as a motto – and, incidentally, a concern that has always been assumed by the European Union –, we suspect that its guarantee could be more properly safeguarded if the creation of the EIO had been preceded by a mature and admitted European criminal policy. In view of the absence of the latter, we find ourselves in a context in which incompatible criminal procedural rights are crossed in issues so acutely related to the protection of fundamental rights as the exclusionary rules. We allow ourselves to wonder about the possibility that we are facing a new limit to the effect-at-a-distance – not formally recognized, but practically implied. The practical difficulty of investigating the proper production of evidence carried out in a foreign jurisdiction enhances the admissibility of evidentiary material produced in disagreement with the procedural rules of the State where the criminal procedure in question takes place. Once this problem has been detected, we aim to approach an outcome that allows a better balance between the sophistication that criminal repression has been endowed with, and the defense of the position of the accused in transnational criminal proceedings.por
