dc.description.abstractA presente dissertação tem como finalidade estudar as regras de aplicação da lei no tempo nos crimes tributários continuados. A abordagem tem por base a circunstância de serem aplicadas subsidiariamente as regras gerais de aplicação da lei no tempo do CP ao RGIT, e de existir um regime especial de determinação do momento da prática do facto no RGIT que, apesar de ser bastante próximo ao disposto no artigo 3.º do CP, levanta algumas questões. Consequentemente, como todas as regras de aplicação da lei no tempo estão condicionadas por aquele que é definido como o momento jurídico relevante para produção de efeitos jurídicos, se não soubermos ao certo quando o mesmo está verificado, vão surgir sérias incertezas aquando da aplicação da lei no tempo. Com a agravante que pode estar em causa a subsunção de tais regras à figura jurídica do crime tributário continuado. Assim sendo, propomos um estudo de todas estas matérias que permita conhecer profundamente as regras gerais de aplicação da lei no tempo no RGIT, a regra especial de determinação do momento da prática do facto do artigo 5.º do RGIT, as relações entre ambas, a aplicação destas à figura do crime tributário continuado, bem a própria figura jurídica do crime tributário continuado.por
dc.description.abstractThe purpose of this dissertation is to study the rules of law enforcement in time in continuous tax crimes. The approach is based on the fact that the general rules of application of the law at the time of the Criminal Code are subsidiarily applied to the RGIT, and that there is a special regime for determining the moment of the practice of the fact in the RGIT which, although it is quite close to the provisions of article 3 of the Criminal Code, raises some questions. Consequently, as all the rules of application of the law in time are conditioned by what is defined as the relevant legal moment for the production of legal effects, if we do not know for certain when the same is verified, serious uncertainties will arise when applying the law in time. With the aggravating factor that may be at stake is the subsumption of such rules to the legal figure of the continuous tax crime. Therefore, we propose a study of all these matters that will allow us to have a deep understanding of the general rules of law application in time in RGIT, the special rule of determining the moment of the practice of article 5 of RGIT, the relations between the two, their application to the figure of the continuous tax crime, as well as the legal figure of the continuous tax crime itself.por
