Abstract

O abuso sexual de menores é um fenómeno, vivenciado pelas crianças e jovens, na maioria das vezes, em silêncio, dado que acontece, sobretudo, num contexto de intimidade e/ou familiar, no qual se criam dinâmicas muito específicas, o que o transforma num crime camuflado, sem grande visibilidade e frequentemente encoberto. O presente estudo tem como objeto o estudo dos tipos legais do art.171.º e 172.º do CP, crimes que atentam atenta contra a liberdade e autodeterminação sexual do menor, através de uma passagem pela sua evolução histórica e pelo tipo objetivo e subjetivo de ilícito. A obtenção de prova nestes tipos legais, especificamente, de prova testemunhal e pericial, é bastante complexa devido as especificidades do menor e do ambiente circundante ao abuso. A investigação criminal enfrenta, diversas adversidades e contrariedades na produção de prova, por consequência, existe uma dificuldade acrescida na tomada de decisão pelas autoridades judiciárias. A perícia médico-legal tem uma elevada importância probatória, fazendo-se valer dos especiais conhecimentos técnicos, científicos ou artísticos do perito, para apurar factos novos, que podem ser imprescindíveis para a solução do caso submetido a julgamento. Acontece que, frequentemente, os abusos não deixam vestígios ou sequelas físicas, na ausência de provas materiais, através da perícia médico-legal, as avaliações psicológicas forenses são em simultaneidade com o testemunho da vítima, um dos poucos meios de prova existentes. No que diz respeito ao testemunho das crianças e jovens, este trata-se de meio de prova controverso, devido as problemáticas da memória infantil, nomeadamente, a ocorrência de falsas memórias e a propensão à sugestão. Assim, a prova testemunhal do menor pode ser único meio para aferir a verdade material. Já que, dificilmente, ocorrerá uma confissão por parte do agressor. As declarações de memória futura apresentam-se, protetivas das vítimas especialmente vulneráveis, como são as crianças e jovens, ao mesmo que tempo preservam o testemunho através da sua realização antecipada, evitando-se a perda de memórias e revitimização. Toda a abordagem ao longo do estudo, terá por base a análise da jurisprudência e doutrina dominante.

Sexual abuse of minors is a phenomenon, lived by children and young people, most times, in silence, given that it occurs, mostly, in an intimate and/or familiar context, in which very specific dynamics are created, which transform it in a camouflaged crime, without much visibility and often hidden. The present study has as its object the study of legal types of art.171.º and 172.º of the CP, crimes which attack the sexual freedom and self-determination of the minor, passing through his historic evolution and the objective and subjective type of the illicit. The obtention of proof in these legal types, specifically, of testimonial and expert proof, is very complex due to the specificities of the minor and the environment around the abuse. Criminal investigation faces many adversities and setbacks in the production of proof, therefore, there is an added difficulty in the decision making by judicial authorities. Forensic expertise has an elevated probatory value, using the special technic, scientific or artistic knowledge of the expert, to determine new facts, which may be essential for solving the case submitted to judgment. Frequently, abuses leave no physical vestiges or sequels, in the absence of material proof, through forensic expertise, psychological forensic evaluations, simultaneously with the victim’s testimony, one of the few existing means of proof. Regarding the testimony of children and young people, this is a controversial means of proof, due to the problems of child memory, namely, the occurrence of false memories and the propension for suggestion. Thus, testimonial proof of the minor may be the only means to obtain the material truth. Since a confession by the aggressor is unlikely to occur. Future memory declarations present themselves as protective of especially vulnerable victims, such as children and young people, at the same time preserving the testimony through its anticipation, avoiding memory loss and revictimization. The entire approach through the study will be based in the analysis of the dominant jurisprudence and doctrine.
