This dissertation analyses the right to disconnect, established by Portuguese law as an employer's duty to refrain from contacting employees outside working hours. This legal framework is a response to increasing hyperconnectivity and digital transformations, which are eroding the boundaries between work and personal time. The research is based on an analysis of doctrine, legislation, and case law, including international comparisons, with a particular focus on the protection of health, privacy, and the worker's work-life balance. It assesses the impact of new technologies on blurring the lines between professional and personal life, as well as the challenges in implementing this right in practice. The study emphasises that the mere legal recognition of the duty to refrain from contact is not sufficient to ensure its effectiveness. For it to be meaningful, this principle must be integrated into collective bargaining agreements, company regulations, internal policies, and cultural or social awareness programmes. Furthermore, the legislation provides for sanctions in case of non-compliance, ensuring the implementation of concrete organisational and legal strategies. These measures are crucial for the effective protection of workers and for fostering a balanced employment relationship that respects their dignity.eng
