dc.description.abstractA presente dissertação versa sobre a utilização da inteligência artificial como facto tributário. Propõe-se verificar se devem ou não ser tributados os rendimentos obtidos por parte das empresas com base nestes mecanismos e, em caso afirmativo, de que modo devem ser tributados, em Portugal. De forma a podermos compreender, por um lado, a envolvente da inteligência artificial foi necessário estudar a sua contextualização histórica, a sua noção, bem como o seu enquadramento legal. Por outro lado, analisamos o facto tributário, designadamente a sua origem histórica e as suas dimensões essenciais, de modo a verificar se a inteligência artificial configura uma nova fonte de rendimento tributável, isto é, se o seu uso configura um facto tributário. Neste sentido, procuramos analisar a tributação deste novo facto tributário por via dos diversos tributos (imposto; taxa; contribuições especiais e contribuições financeiras a favor de entidades públicas), bem como os fundamentos principiológicos que, em sede de Direito a constituir, norteariam o enquadramento tributário desta realidade. Por fim, dedicamo-nos a fazer um levantamento de desafios associados à tributação da inteligência artificial.por
dc.description.abstractThis dissertation addresses the use of artificial intelligence as a taxable event. It aims to determine whether the income generated by companies through these mechanisms should be taxed, and if so, how they should be done in Portugal. To understand the context of artificial intelligence, it was necessary to study its historical background, definition, and legal framework. Additionally, we examined the concept of a taxable event, particularly its historical origins and essential dimensions, in order to determine whether artificial intelligence constitutes a new source of taxable income—i.e., whether it qualifies as a taxable event. In this regard, we seek to analyze the taxation of this new taxable event through various types of taxes (taxes, fees, special contributions, and financial contributions in favor of public entities), as well as the foundational principles that, in the realm of lawmaking, would guide the tax framework of this reality. Finally, we focus on identifying the challenges associated with taxing artificial intelligence.por
