Contributos para a compreensão do direito mineiro angolano partindo do modelo de desenvolvimento económico adotado na Constituição da República de Angola

Abstract

A presente tese busca, com base na análise socioeconómica, histórica e comparada, compreender os regimes jurídicos que integram o Direito Mineiro angolano e da sua articulação no quadro da implementação do modelo constitucional de desenvolvimento. Ao caraterizar o modelo constitucional de desenvolvimento, estudam-se alguns dos princípios constitucionais mais relevantes desse modelo, bem como discutem-se os problemas teóricos e práticos da sua aplicação nos regimes dos minerais, enquanto norteadores do Direito Mineiro Angolano. Essa discussão foi solidificada com a experiência comparada da legislação mineira da África do Sul, Austrália, Brasil, Moçambique e Portugal. À tese, extraem-se importantes lições da evolução do processo desenvolvimentista angolano influenciado pela atividade mineira e direito aplicável nas suas diferentes etapas, na modelação dos atuais regimes dos minerais, bem como na perspetivação de melhorias para melhor se adequarem ao modelo constitucional de desenvolvimento. A tese, ao identificar o desenvolvimento sustentável como modelo constitucional de desenvolvimento, discute os problemas atinentes aos mecanismos legais e institucionais estabelecidos nos regimes dos minerais, estudando as diversas formas de intervenção do Estado no setor mineiro na ótica da regulação para o desenvolvimento sustentável. Depois de discorrido sobre as conclusões mais importantes, termina com propostas concretas de reforma do Direito Mineiro angolano de modo a tornar os seus instrumentos jurídicos mais adequados ao modelo constitucional de desenvolvimento e que confiram maior atratividade ao setor mineiro angolano.

Based on socioeconomic, historical, and comparative analysis, this thesis seeks to understand the legal regimes that make up the Angolan Mining Law and their articulation within the framework of the implementation of the constitutional model of development. In characterizing the constitutional model of development, some of the most relevant constitutional principles of this model are studied, as well as the theoretical and practical problems of their application in the mineral regimes, as guiding principles of the Angolan Mining Law, are discussed. This discussion was solidified with the comparative experience of the mining legislation of South Africa, Australia, Brazil, Mozambique, and Portugal. The thesis draws important lessons from the evolution of the Angolan development process influenced by the mining activity and applicable law in its different stages, in the shaping of the current mineral regimes, as well as in the perspective of improvements to better fit the constitutional model of development. The thesis, by identifying sustainable development as a constitutional model of development, discusses the problems related to the legal and institutional mechanisms established in the mineral regimes, studying the various forms of state intervention in the mining sector in a perspective of regulation for sustainable development. After discussing the most important conclusions, it ends with concrete proposals for the reform of Angolan Mining Law in order to make its legal instruments more adequate to the constitutional model of development and that confer greater attractiveness to the Angolan mining sector.
