dc.description.abstractNum Estado de Direito, os impostos não existem sem sistema. E por aqui já se apresenta a resposta à interrogação que serve de título à presente dissertação: sim, existe um sistema fiscal português. Ao longo da presente investigação procuramos identificar os pressupostos jurídico-dogmáticos de cuja consideração dependerá a conclusão de que o agregado normativo que serve de base à instituição e funcionamento de um conjunto de impostos terá uma composição sistémica. O método utilizado para levar a efeito o exercício proposto assentará numa decomposição dos elementos constitutivos do conceito de sistema fiscal e sua sucessiva reconstrução à luz de dados normativos espacial e temporalmente localizados: as normas fiscais vigentes em Portugal. Partiremos de um elementar conceito de “sistema”; observaremos as condições da sua integração no mundo jurídico; e procuraremos delimitar os contornos da sua aplicação ao fenómeno fiscal enquanto realidade juridicamente disciplinada. Estes desenvolvimentos serão acompanhados de uma concomitante subsunção dos dados normativos tomados por referência às estruturas concetuais desenvolvidas. Concluiremos que a exigência de um módico de configuração sistémica na composição do tecido normativo fiscal não constituirá uma simples conveniência ou dimensão de ordem estética, antes se apresenta como um imperativo inelutável, sob pena de resultarem frustradas as exigências básicas de igualdade e segurança jurídica que integram o núcleo essencial da juridicidade. Considerando o contexto normativo de referência, esta condição será satisfeita, pelo menos a um nível mínimo. dc.description.abstractUnder Rule of Law, taxes do not exist without a system. And here is the answer to the question that serves as the title of this dissertation: yes, there is a Portuguese tax system. In the course of the present research we seek to identify the legal and dogmatic assumptions upon whose consideration will depend the conclusion that the legal framework that serves as the basis for the institution and operation of a set of taxes will have a systemic composition. The method used to carry out the proposed exercise will be based on a decomposition of the constituent elements of the tax system concept and its successive reconstruction in the light of spatial and temporal normative data: the tax legislation applicable in Portugal. We will start from an elementary concept of “system”; we will observe the conditions of its integration in the legal world; and we will try to delimit the outlines of its application to the fiscal phenomenon as a legally disciplined reality. These developments will be accompanied by a concomitant subsumption of the normative data taken by reference to the developed conceptual structures. We will conclude that the requirement of a modicum of systemic configuration in the composition of the fiscal normative fabric shall not constitute a simple convenience or aesthetic dimension, but rather an inescapable imperative, otherwise the basic requirements of equality and legal security that make up the essential core of legality will be frustrated. Given the legal context of reference, this condition will be met at least at a minimum level. The Portuguese tax system is not perfect, it is the possible system, but it is certainly a system.por
