| dc.description.abstract | Double Taxation Conventions are an important subject of study in International Tax Law. The spread and increase in the number of treaties on this subject reflect the dynamics of the transnational movement of capital. Despite successive reforms in the Model Conventions of International Organizations (i.e. OECD and UN), the evolution of the global economy, with the emergence of large technology companies, has accentuated the need to modernize basic legal concepts included in the bilateral agreements. It should be noted that the concept of Permanent Establishment, crucial in determining the tax capacity of States contracting double taxation agreements, has evolved to deal with the challenges of the digital economy. The traditional notion of a significant physical presence has been relativized so that the concept encompasses new forms of business activity. In this context, based on the efforts of OECD members, the Multilateral Convention to Implement tax treaty related Measures to Prevent Base Erosion and Profit Shifting (MLI) was created. The fast evolution of the digital economy poses significant challenges to International Tax Law and to efforts against the erosion of States' tax bases. To address such difficulties, the MLI constitutes a creative mechanism to enable the rapid reform of Bilateral International Conventions to eliminate Double Taxation and, most importantly, to modernize the concept of Permanent Establishment, ensuring the active tax capacity of the States contracting to such conventions. | por |
