| dc.description.abstract | More than anything, this is a research paper that seeks to analyze, in the most complete way possible, the most recent legislative updates, concerning the access, storage and treatment of personal data, particularly biometric data. For that purpose, we take into consideration the General Data Protection Regulation, the Charter of Fundamental Rights of the European Union, the European Convention on Human Rights. Additionally, the decisions of the European Court of Human Rights and the Court of Justice of the European Union, to familiarize others with specific examples of the possible violations of the rights and freedoms of the data subject. Complimenting the Constitution of the Portuguese Republic and the national laws no. 12/2005, of January 26 and no. 5/2012, of January 23, we analyze the Portuguese Labour Law, about the protections it stipulates, of the employee and his personal data, in his work relationship, one of subordination to the employer. Portugal, by being a Member-State and an interested party in the EU, must hold its own laws to the standards of the European instruments referred previously. With that same intent, we consider the Opinions of the Working Party of the Article 29, to find doctrinal support in any conclusions we make. Furthermore, we explore the evolution of the information systems, so that, with that knowledge, it becomes clear how we have the current biometric technologies, but also, the very real dangers of a modern homo conectus. Finally, we connect the subjects of biometric technologies and artificial intelligence, by exploring the methods that, involving intelligent agents and neural networks, allow the optimization of the former. It is the intent of the writer of the dissertation, that both the investigation and the writing process are guided by objectivity, clarity and rigor of the scientific and legal analysis. Whenever proper and possible, the topics were presented on a doctrinal, technical and jurisprudential framework. | por |
