| dc.description.abstract | Stalking is a type of interpersonal violence defined by a pattern of persistent harassment. In Europe, the estimated prevalence is 19.5% and in Portugal 20.7%. Internationally, little is known about how the justice system treats the crime of stalking when it’s reported. This exploratory study aims to characterize victims and perpetrators, criminal dynamics, and the prosecution of this crime in Portugal, based on an analysis of 182 first and second instance court decisions from Portuguese courts. The perpetrator was typically male, single, and on average 45.27 years old at the time of the first occurrence. The victim was mostly characterized as a woman. The crime of stalking was mostly perpetrated online and offline simultaneously, over 1 to 6 months, on a daily or weekly basis. In these cases, 59.21% the conclusion was convicted, and 14.40% of the cases were closed due to the victim giving up. In 43.30% of the court decisions analyzed, reparation measures were applied to the victims, averaging 4291,12€. The most frequently used evidence was personal testimony, and the least used was forensic expertise. Recommendations are made to improve the effectiveness of the justice system in dealing with stalking. | por |
