Abstract

A evolução tecnológica tem transformado profundamente a vida quotidiana, trazendo, ao mesmo tempo, desafios significativos para o Direito, especialmente no campo do Direito Sucessório. Com o aumento da conectividade à internet, as pessoas acumulam bens e conteúdos digitais, que podem ter ou não valor económico, como e-books, músicas, NFTs e perfis em redes sociais. A transmissão desses bens após a morte levanta questões complexas, uma vez que a legislação vigente não abrange especificamente a sua sucessão, resultando em incertezas quanto ao destino desses ativos. O presente trabalho explora como ocorre a sucessão mortis causa de bens digitais no contexto do ordenamento jurídico português, analisando a necessidade de adaptação do Direito às novas realidades trazidas pela tecnologia. A pesquisa realizada utiliza um método dedutivo descritivo e exploratório, fundamentando-se numa revisão bibliográfica abrangente. O estudo busca esclarecer se e como os bens digitais devem ser incluídos na herança, considerando os direitos de personalidade e a privacidade do falecido, bem como as lacunas legais e os desafios éticos envolvidos. O estudo iniciará com uma análise do direito civil e sucessório, destacando aspetos fundamentais para entender a transmissão de bens digitais. Serão discutidos os conceitos essenciais do direito de personalidade, incluindo a aplicação e a temporalidade desses direitos após a morte, com foco nos direitos à imagem, à reputação e à privacidade, além do direito ao esquecimento. Em seguida, será explorado o tema dos bens digitais, examinando os avanços tecnológicos e o cenário jurídico atual que os envolve. Serão apresentados conceitos e classificações de bens digitais, como e-books, músicas digitais, NFTs, jogos online e perfis em redes sociais, analisando as suas características e valores económicos. A pesquisa também abordará a sucessão mortis causa desses ativos digitais, examinando o conceito de herança digital, a sua admissibilidade e como esses bens interagem com os direitos de personalidade. Além disso, haverá uma comparação com a abordagem adotada em outros países. Por fim, as considerações finais irão resumir os principais pontos discutidos, apresentando soluções práticas e recomendações para garantir a proteção dos direitos dos herdeiros e a adequada preservação do património digital após a morte.

Technological evolution has profoundly transformed daily life, presenting significant challenges to the law, particularly in the field of Succession Law. With increasing internet connectivity, people accumulate digital assets and content of both economic and non-economic value, such as e-books, music, NFTs, and social media profiles. The transmission of these assets after death raises complex questions, as current legislation does not specifically cover their succession, resulting in uncertainties regarding the fate of these assets. This paper explores how the succession mortis causa of digital assets occurs within the context of the Portuguese legal system, analyzing the need for the legal adaptation to the new realities brought about by technology. The research employs a descriptive and exploratory deductive method, grounded in a comprehensive literature review. The study aims to clarify whether and how digital assets should be included in an inheritance, considering the rights of personality and the privacy of the deceased, as well as the legal gaps and ethical implications. The study begins with an analysis of civil and succession law, highlighting fundamental aspects to understand the transmission of digital assets. Essential concepts of personality rights will be discussed, including the application and temporality of these rights after death, focusing on the rights to image, reputation, and privacy, in addition to the right to be forgotten. Subsequently, the topic of digital assets will be explored, examining technological advancements and the current legal framework surrounding them. Concepts and classifications of digital assets, including ebooks, digital music, NFTs, online games, and social media profiles will be presented, analyzing their characteristics and economic values. The research will further address the succession mortis causa of these digital assets, examining the concept of digital inheritance, its admissibility, and the interplay between these assets and personality rights. Additionally, a comparison with the approaches adopted in other countries will be provided. Finally, the concluding remarks will summarize the main points discussed, presenting practical solutions and recommendations to ensure the protection of heirs' rights and the proper preservation of digital assets after death.
