This research focuses on the use of electric scooters as a means of transportation and the debate over the mandatory insurance requirements for these vehicles in Portugal. The study uses the legal research method, which involves the critical analysis of standards, doctrines, court decisions and relevant literature to provide in-depth knowledge on legal issues and propose solutions to legal problems. The general objective of this study is to establish comprehensive and effective strategies that allow a responsible and safe use of electric scooters on urban roads. The specific objectives seek to: 1) evaluate legislation and regulations applicable to electric scooters in other countries, especially in the Member States of the European Union; 2) identify gaps in existing Portuguese regulations and effective regulatory approaches that can be adapted to the national reality; 3) understand the historical context and the main issues raised in the use of electric scooters; 4) Analyze the discourses regarding the mandatory subscription of insurance for electric scooters, with emphasis on concerns about user safety, civil liability and accessibility of electric scooters as a means of transport; 5) Understand the legal implications arising from accidents involving electric scooters; 6) Understand the legal challenges associated with the use/driving of electric scooters and how they can be addressed effectively; 7) Develop concrete recommendations that can improve public policies and regulations related to electric scooters in the Portuguese context, taking into account the need to implement mandatory insurance. It was argued in this research that insurance for electric scooters should be mandatory, depending on the period of use: if for private use, in a similar way to other vehicles; if for shared use, it should be contracted according to the period of use. The results indicated that Portugal lacks specific regulations for the use of electric scooters in the national territory. In conclusion, the use of electric scooters has grown to the point where their indiscriminate use can no longer be ignored by legislative authorities, where there has been a significant increase in accidents and conflicts on urban roads. Regulation and monitoring need to become more rigorous so that users understand the risks of improper driving and their responsibility for their actions.por
