This dissertation aims to study the Limits of Employer Control Power in the face of the current technological reality. The discussion presented is based on three fundamental premises: (i) in recent decades, there have been numerous advances in Neurotechnology and AI, massifying their use within labor relations, without, in parallel, rigorous regulation of these neurodevices, which, therefore, will potentially be used for abusive purposes; (ii) there is a growing trend, intensified in the post-pandemic period, towards neurosurveillance of workers and (iii) the interest in the use of neurodevices in the workplace stems, above all, from the possibility of intensive control of professional performance, although it is often instituted under the rhetoric of organizational well-being, increased productivity or guaranteed safety. The improvement of AI algorithms has enabled the interpretation of large volumes of neural data, essential to understanding the patterns of brain activity, which provide valuable insights into the cognitive operations, states and emotional responses of the worker throughout the workday. In the absence of effective regulation, unjustified employer conduct will be masked, overriding the legitimate verification of the work performed, making conclusions available to him that should not be evaluated by him. The issue at hand is one of considerable factual, doctrinal, and jurisprudential novelty, which proves not only the need for the investigation now intended, but also the concrete hope of contributing to the development of a new era in the history of legal thought, aimed at granting protection to brain data. The central question that labor legislators will have to answer is, surely, the (in)admissibility of access by the employer to the neural data, states, and intentions of the worker. To this end, looking at established law, it will be considered whether the current regulatory frameworks will be sufficient to guarantee adequate protection of the worker's privacy and dignity. Finally, de iure constituendo, a normative proposal will be presented to be included in the Labour Code.eng
